CANADIAN INTERNATIONAL TRADE TRIBUNAL
DETERMINATION
Hotels and motels and inns
Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2024-004) on July 22, 2024, with respect to a complaint filed by Newland Canada Corporation (Newland) of Calgary, Alberta, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (Solicitation WS4447121548) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of accommodation services in the city of Québec, Quebec, from the beginning of May to the end of August 2024.
Newland alleged that PWGSC wrongly awarded the contract to a bidder that did not comply with a mandatory requirement of the solicitation.
Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was valid in part.
Further information may be obtained from the Registry, 613‑993‑3595 (telephone), citt-tcce@tribunal.gc.ca (email).

CANADIAN INTERNATIONAL TRADE TRIBUNAL
DETERMINATION
Office furniture
Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2023-064) on July 25, 2024, with respect to a complaint filed by Global Total Office (GTO), of Toronto, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (Solicitation W6863-11-161) by the Department of National Defence (DND). The solicitation was for the provision and installation of office furniture and seating.
GTO alleged that DND privately issued the solicitations to three bidders instead of publicly posting them; that the Requests for Quotation (RFQs) explicitly referred to specific Supply Arrangements (SA) but did not include direction concerning product specifications or Government of Canada identification codes; that the RFQs were issued, evaluated, and awarded in a manner where both SA were not separated; that a contract was awarded to GTO but was subsequently improperly cancelled; that the regret letters to competing bidders exposed GTO’s total bid price, which resulted in an unfair and prejudiced second procurement process; and that bidders were only provided four calendar days to respond to the second solicitation.
Having examined the evidence presented by the parties and considered the provisions of the applicable trade agreement, the Tribunal determined that the complaint was valid in part.
Further information may be obtained from the Registry, 613‑993‑3595 (telephone), citt-tcce@tribunal.gc.ca (email).

EXPIRY REVIEW OF ORDER
Thermoelectric warmers and coolers
The Canadian International Trade Tribunal gives notice that, pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), it will initiate an expiry review (Expiry review RR-2024-003) of its order made on September 5, 2019, in expiry review RR-2018-004, continuing, without amendment, its order made on December 9, 2013, in Expiry review No. RR-2012-004, continuing, without amendment, its finding made on December 11, 2008, in inquiry NQ-2008-002, concerning the dumping and subsidizing of thermoelectric warmers and coolers that provide cooling and/or warming with the use of a passive heat sink and a thermoelectric module, excluding liquid dispensers, originating in or exported from the People’s Republic of China (the subject goods).
In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping or subsidizing of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping or subsidizing, the Tribunal will then determine if the continued or resumed dumping or subsidizing is likely to result in injury to the domestic industry. The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal’s initiation of the expiry review, that is, no later than December 24, 2024. The Tribunal will issue its order and its statement of reasons no later than June 2, 2025.
Each person or government wishing to participate in this expiry review must file Form I—Notice of Participation with the Tribunal by August 13, 2024. Regarding the importance of the deadline for filing a notice of participation, please read carefully the “Support by domestic producers” section in the notice available on the Tribunal’s website. Each counsel who intends to represent a party in the expiry review must file Form II—Notice of Representation and Form III—Declaration and Undertaking with the Tribunal, by August 13, 2024. The Tribunal will issue a list of participants shortly thereafter.
On February 17, 2025, the Tribunal will distribute the record to participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those participants who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed Form III—Declaration and Undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.
The Tribunal will hold a public hearing relating to this expiry review commencing on March 17, 2025. The type of hearing will be communicated at a later date.
Written submissions, correspondence and requests for information regarding the Tribunal’s portion of this expiry review should be addressed to the Deputy Registrar, Secretariat to the Canadian International Trade Tribunal, at citt-tcce@tribunal.gc.ca. The Registry can also be reached at 613‑993‑3595. Additional information and the expiry review schedule are available in the notice posted on the Tribunal’s website.
