CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999
Whereas the Minister of the Environment has been provided with information under paragraph 87(5)(a) of the Canadian Environmental Protection Act, 1999 footnote a in respect of each substance referred to in the annexed Order;
Whereas the period for assessing the information under section 83 of that Act has expired;
And whereas no conditions specified under paragraph 84(1)(a) of that Act in respect of the substances are in effect;
Therefore, the Minister of the Environment makes the annexed Order 2023-87-11-01 Amending the Domestic Substances List under subsection 87(5) of the Canadian Environmental Protection Act, 1999 footnote a.

Order 2023-87-11-01 Amending the Domestic Substances List
Amendments
1 Subsection 2(6) of the Domestic Substances List footnote 1 is replaced by the following:
(6) The letter “P” after the number of a substance in one of Parts 1 to 8 indicates that the substance is a reduced regulatory requirement polymer or biopolymer that
- (a) is not one of the types listed in items 1 to 4 of Schedule 7 to the New Substances Notification Regulations (Chemicals and Polymers) and that has a number average molecular weight greater than 10 000 Da, with less than 2% of its components having molecular weights of less than 500 Da and less than 5% of its components having molecular weights of less than 1 000 Da;
- (b) is not one of the types listed in Schedule 7 to those Regulations and that has a number average molecular weight greater than 1 000 Da and equal to or less than 10 000 Da, with less than 10% of its components having molecular weights of less than 500 Da and less than 25% of its components having molecular weights of less than 1 000 Da; or
- (c) is a polyester manufactured solely from reactants listed in Schedule 8 to those Regulations, or an anhydrous form of those reactants, other than the reactants or their anhydrous forms that include both 1-butanol and fumaric or maleic acid.

Coming into Force
4 This Order comes into force on the day on which it is registered.
