Her Excellency the Governor General in Council, on the recommendation of the Minister of Indigenous Services, makes the annexed Regulations Amending the Fort William First Nation Sawmill Regulations (Miscellaneous Program) under section 3footnote a of the First Nations Commercial and Industrial Development Act footnote b.
Regulations Amending the Fort William First Nation Sawmill Regulations (Miscellaneous Program)
Amendments
1 Schedule 1 to the Fort William First Nation Sawmill Regulations footnote 1 is replaced by the Schedule 1 set out in the schedule to these Regulations.
2 Section 8 of Part 3 of Schedule 2 to the Regulations is replaced by the following:
Limit of application
8 The Environmental Assessment Act (R.S.O. 1990, c. E.18) and its regulations apply only in circumstances where the Impact Assessment Act does not apply.
Coming into Force
3 These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT
(This statement is not part of the Regulations.)
Issues
In 2011, the Fort William First Nation Sawmill Regulations (the Fort William Regulations) were made under the authority of the First Nations Commercial and Industrial Development Act (FNCIDA). The Fort William Regulations incorporate by reference the relevant provincial laws and regulations that govern the operation of sawmills in Ontario in order to provide greater certainty respecting the regulation of this on-reserve project. Since 2011, a number of the incorporated provincial laws have been repealed or have become spent, and a number of incorporated instruments have been updated or replaced. Minor technical amendments are needed to reflect the changes in order to ensure the references are consistent with the updated provincial laws and instruments.
Objective
The amendments have the following objectives:
- To update references to incorporated provincial laws and instruments that have been updated, repealed or are spent.
- To add numbering to the schedule of incorporated provincial laws and instruments.
Description and rationale
Since the Fort William Regulations were first made in 2011, more than 30 changes to incorporated provincial statutes, regulations and other instruments have been made. These changes should be reflected in Schedule 1 of these regulations to promote clarity and legal certainty.
Schedule 1 of the Fort William Regulations is therefore replaced with a new schedule, incorporating amendments that include the following:
- The addition of numbering to the schedule’s list of incorporated laws and instruments for ease of reference and to reflect modern drafting conventions.
- Updated references that reflect the repeal of multiple regulations under the Environmental Protection Act (R.S.O. 1990, c. E. 19) and the Ontario Water Resources Act (R.S.O. 1990, c. O.40), as well as the repeal of certain sections of the Crown Forest Sustainability Act, 1994 (S.O. 1994, c. 25) and the Lakes and Rivers Improvement Act (R.S.O. 1990, c. L.3).
- Updated references to certificates, licenses and requirements for fees issued under the Environmental Protection Act (R.S.O. 1990, c. E.19) and the Ontario Water Resources Act (R.S.O. 1990, c. O.40).
Schedule 2 is also revised to reflect the replacement of the Canadian Environmental Assessment Act (S.C. 1992, c. 37) with the Impact Assessment Act (S.C. 2019, c. 28, s. 1).
Regulatory analysis
One-for-one rule and small business lens
The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to businesses.
Analysis under the small business lens determined that the amendments will not impact small businesses in Canada.
