Coming into Force

Proposal
The Canadian Grain Commission (CGC) has proposed the Regulations Amending the Canada Grain Regulations that affect Schedule 3 as follows:
- Table 25 (Peas, Canada Green)
Objective
The regulatory amendment to modify Table 25 is based on the recommendation of the western and eastern standards committees to change the splits tolerance in No. 2 Canada green peas from 1% to 3%.
Background
Table 25 (Peas, Canada Green)
The CGC’s grain grading system is continually reviewed to ensure it provides value to the Canadian grain sector. The system is designed to be flexible, meeting the changing needs of producers, industry and customers. Under the Canada Grain Act (CGA), the CGC may establish grades and grade names for any kind of western grain and eastern grain and establish the specifications for those grades.
Currently, the splits tolerance for No. 2 Canada green peas is 1%, while the splits tolerance for No. 2 Canada yellow peas is 3%. As there is no supporting operational or end-use impact rationale for why the splits tolerances are different, grain sector stakeholders have requested that the splits tolerances for No. 2 Canada Green and No. 2 Canada yellow peas be aligned at 3%.
Consultations with the Canadian pulse sector have confirmed that No. 2 Canada Green pea trade transactions currently use a 3% splits tolerance instead of the CGC 1% grading tolerance. Pulse sector stakeholders have confirmed that this operational practice has no impact to end users and that grain handlers, exporters and buyers routinely accept up to 3% splits.
Consultations
Table 25 (Peas, Canada Green)
As consultations are required with the standards committees regarding all grading tables and associated grading specifications in Schedule 3, the proposed change to Table 25 was provided to the Western Standards Committee on April 5, 2022, and to the Eastern Standards Committee on April 6, 2022. Subsequently, the standards committees passed motions to recommend that the CGC change the splits tolerance in No. 2 Canada green peas from 1% to 3% effective August 1, 2022.
Coming into force
These Regulations come into force on August 1, 2022, in all regions of Canada, but if the Regulations are registered after that day, they come into force on the day on which they are registered.
