Coming into Force

EXPLANATORY NOTE

Proposal
The Canadian Grain Commission (CGC) has made amendments to Schedule I and Schedule III of the Off Grades of Grain and Grades of Screenings Order, as follows:
- the addition of canaryseed to Schedule I to outline the tough and damp moisture ranges;
- the addition of Wheat, Canada Eastern Other Wheats to Schedule III to outline the tough and damp moisture ranges; and
- the elimination of the following wheat classes from Schedule III:
- Wheat, Canada Eastern Red;
- Wheat, Canada Eastern Hard White Winter;
- Wheat, Canada Eastern Soft White Spring; and
- Wheat, Canada Eastern Hard White Spring.
Objective
The amendments to Schedules I and III align the Order with previous amendments to the Canada Grain Regulations (CGR).
Background
Schedule I — Canaryseed, Canada (CAN)
An amendment to subsection 5(1) of the CGR to add canaryseed to the list of grains designated under the Canada Grain Act (CGA) was registered and published in the Canada Gazette, Part II (P.C. 2021-462, June 1, 2021). Including canaryseed under the CGA ensures that canaryseed producers are eligible for compensation under the CGC's Safeguards for Grain Farmers Protection Program, and for its other grain grading and quality assurance services. In addition, a corresponding amendment to Schedule III of the CGR to add Table 62 — Canaryseed was registered and published in the Canada Gazette, Part II (SOR/2021-92). As per subsection 5(2) of the CGR, this table sets out the official grade name and grading specifications for canaryseed.
As a consequence of these amendments, an update to Schedule I of the Off Grades of Grain and Grades of Screenings Order is required to add canaryseed to outline the tough and damp moisture ranges.
Schedule III — Canada Eastern Wheat classes
In 2018, amendments to Schedule III of the CGR were made to modernize eastern wheat classes. These amendments streamlined and simplified the classes and increased system flexibility for producers, breeders, processors and handlers. These amendments were registered and published in the Canada Gazette, Part II (SOR/2019-211).
As a consequence, amendments are required to Schedule III of the Off Grades of Grain and Grades of Screenings Order to
- add the Canada Eastern Other Wheat class and outline the tough and damp moisture ranges; and
- eliminate the Canada Eastern Red, Canada Eastern Hard White Winter, Canada Eastern Soft White Spring, and Canada Eastern Hard White Spring wheat classes.
Consultation
Schedule I — Canaryseed, Canada (CAN)
Throughout spring and fall 2020, the CGC consulted with relevant sector stakeholders, including the Canary Seed Development Commission of Saskatchewan, all registered canaryseed buyers, third-party inspection companies, and the Western Standards Committee, to determine the appropriate grade specifications to include in the canaryseed grade determinant table and the Official Grain Grading Guide. At the November 2020 Western Standards Committee meeting, the CGC provided the draft grading determinant table and the results of the consultation to committee members for review. The Western Standards Committee subsequently passed a motion for the CGC to adopt the canaryseed grade determinant table, effective August 1, 2021.
The CGC has notified grain sector stakeholders and producers that all canaryseed varieties will be designated under the CGA as of August 1, 2021. The amendments to the Off Grades of Grain and Grades of Screenings Order are a direct result of this amendment.
Schedule III — Canadian Eastern Wheat classes
As part of its Grain Grading Modernization Initiative, the CGC conducted extensive consultations in 2018 and reviewed all eastern Canadian wheat classes to ensure that the classes were reflective of the wheat being grown and marketed by the grain sector. The amendments to the Off Grades of Grain and Grades of Screenings Order are a direct result of the amendments made to the CGR in 2018.
Coming into force
This Order will come into force on August 1, 2021, but if the Order is registered after that day, it comes into force on the day on which it is registered.
