His Excellency the Administrator of the Government of Canada in Council, on the recommendation of the Minister of Transport, pursuant to subsection 265(2) of the Budget Implementation Act, 2019, No. 1 footnote a, makes the annexed Regulations Repealing Certain Regulations Made Under the Pilotage Act (Tariff Regulations — Miscellaneous Program).
Regulations Repealing Certain Regulations Made Under the Pilotage Act (Tariff Regulations — Miscellaneous Program)
Repeals
1 The following Regulations are repealed:
- (a) the Atlantic Pilotage Tariff Regulations — Newfoundland and Labrador Non-Compulsory Areas footnote 1;
- (b) the Pacific Pilotage Tariff Regulations footnote 2;
- (c) the Atlantic Pilotage Tariff Regulations, 1996 footnote 3; and
- (d) the Laurentian Pilotage Tariff Regulations footnote 4.
Coming into Force
2 These Regulations come into force on the day on which they are published in the Canada Gazette, Part II.
REGULATORY IMPACT ANALYSIS STATEMENT

Issues
As a result of section 238 of the Budget Implementation Act, 2019, No. 1, chapter 29 of the Statutes of Canada, 2019 (the Act), having been brought into force by order in council (SI/2020-40) on June 4, 2020, and pilotage charges having been established by the Pacific Pilotage Authority, the Laurentian Pilotage Authority and the Atlantic Pilotage Authority in accordance with the new sections 33 to 35 of the amended Pilotage Act, the Atlantic Pilotage Tariff Regulations — Newfoundland and Labrador Non-Compulsory Areas, the Atlantic Pilotage Tariff Regulations, 1996, the Laurentian Pilotage Tariff Regulations and the Pacific Pilotage Tariff Regulations (jointly referred to as the Pilotage Tariff Regulations) have become obsolete and need to be repealed as per subsection 265(2) of the Act.
Objective
To repeal the Pilotage Tariff Regulations given that the enabling authority has been repealed and pilotage charges have been established by each pilotage authority.
Description and rationale
These Regulations will repeal the Pilotage Tariff Regulations as per subsection 265(2) of the Act. Consistent with the new section 33 of the amended Pilotage Act, each pilotage authority has established pilotage charges by resolution, making the Pilotage Tariff Regulations obsolete.
One-for-one rule and small business lens
The one-for-one rule applies since four regulatory titles are removed, and the proposal is considered a title out.
Analysis under the small business lens determined that the proposal will not impact small businesses in Canada.
