BROADCASTING ACT

Whereas, pursuant to subsection 10(3) of the Broadcasting Act footnote a, a copy of the proposed Regulations Amending the Simultaneous Programming Service Deletion and Substitution Regulations, substantially in the annexed form, was published in the Canada Gazette, Part I, on June 8, 2019 and a reasonable opportunity was given to licensees and other interested persons to make representations to the Canadian Radio-television and Telecommunications Commission with respect to the proposed Regulations;

Therefore, the Canadian Radio-television and Telecommunications Commission, pursuant to subsection 10(1) of the Broadcasting Act footnote a, makes the annexed Regulations Amending the Simultaneous Programming Service Deletion and Substitution Regulations.

Regulations Amending the Simultaneous Programming Service Deletion and Substitution Regulations

Amendments

1 (1) The definition Canadian television station in subsection 1(1) of the Simultaneous Programming Service Deletion and Substitution Regulationsfootnote 1 is replaced by the following:

Canadian television station means a television programming undertaking that is licensed as a television station or that provides its Canadian programming service by way of a transmitting antenna, and includes an educational authority responsible for an educational television programming service and the stations CTV Two Atlantic, and CTV Two Alberta. (2) Paragraph (c) of the definition local television station in subsection 1(1) of the Regulations is replaced by the following:

Coming into Force

2 These Regulations come into force on the day on which they are registered.

EXPLANATORY NOTE

(This note is not part of the Regulations.)

The Regulations will give effect to the decision of the Canadian Radio-television and Telecommunications Commission (the Commission) to amend the Simultaneous Programming Service Deletion and Substitution Regulations in order to implement the determinations in Broadcasting Decision CRTC 2017-149 dated May 15, 2017. In particular, the Commission determined that satellite-to-cable service CTV Two Alberta should be allowed to request simultaneous substitution similar to satellite-to-cable service CTV Two Atlantic.
