Her Excellency the Governor General in Council, on the recommendation of the Minister for International Trade, pursuant to section 50 of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership Implementation Act footnote a, amends Order in Council P.C. 2018-1314 of October 26, 2018 by replacing “the date of entry into force of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership” with “December 30, 2018”.

Proposal
To amend the Order in Council which fixed the coming-into-force date of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership Implementation Act (the Act) as the day on which the Comprehensive and Progressive Agreement for Trans-Pacific Partnership between Canada, Australia, Brunei, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore and Vietnam (the CPTPP) comes into force for Canada.
Objective
- To fix the specific date on which the Act will come into force.
Background
The CPTPP provides that it comes into force 60 days after the sixth Party to the CPTPP notifies the Depositary (New Zealand), in writing, of the completion of its domestic ratification procedures. On October 26, 2018, Canada became the fifth nation to ratify the CPTPP. On October 31, 2018, Australia became the sixth country to ratify the CPTPP and thereby triggered the 60-day period mentioned above, allowing the coming-into-force date of the CPTPP to be set as December 30, 2018.
The original Order in Council (SI/2018-101) fixed the coming-into-force date of the Act as the date on which the CPTPP comes into force. At the time that the original Order in Council was made, the exact coming-into-force date was not known as six Parties had not yet ratified the CPTPP.
Implications
This Order amends the original Order in Council to make clear for the Canadian public that the specific coming-into-force date is fixed as December 30, 2018.
