Her Excellency the Governor General in Council, on the recommendation of the Minister of Fisheries and Oceans, pursuant to section 43 footnote a of the Fisheries Act footnote b, makes the annexed Regulations Amending the Ontario Fishery Regulations, 1989 and the Ontario Fishery Regulations, 2007.

Ontario Fishery Regulations, 2007
2 (1) The definition fusil à harpon in subsection 1(1) of the French version of the Ontario Fishery Regulations, 2007 footnote 2 is replaced by the following:
fusil à harpon Est assimilé au fusil à harpon tout dispositif, autre qu’un arc, qui est capable de propulser un harpon. (spear gun)
(2) The definition pêche sportive in subsection 1(1) of the French version of the Regulations is replaced by the following:

(3) The definition vivier in subsection 1(1) of the French version of the Regulations is replaced by the following:

(4) Subsection 1(3) of the Regulations is replaced by the following:
(3) A reference in these Regulations to a species or group of species of fish by its common name as set out in column 1 of Part 1, 2 or 4 of Schedule 1 is a reference to the species or group of species of fish whose scientific name is set out in column 2.
3 (1) Paragraph 2(2)(c) of the Regulations is replaced by the following:
- (c) aquaculture activities carried out by employees of the Ontario Ministry of Natural Resources and Forestry; or
(2) Paragraph 2(2)(d) of the Regulations is replaced by the following:
- (d) artificially created waters into which only fish obtained from either the holder of an aquaculture licence or the holder of a commercial fishing licence have been released for non-commercial purposes if those waters
- (i) are not on a regional flood plain,
- (ii) lie wholly within the boundaries of privately owned land,
- (iii) have no connection or outflow to natural waters, and
- (iv) contain water from surface run-off, natural springs, ground water or water pumped from a stream or lake.
4 Subsection 3(2) of the Regulations is replaced by the following:
(2) Subsection (1) does not apply to persons carrying out their duties as employees of the Ontario Ministry of Natural Resources and Forestry or the Department of Fisheries and Oceans.
5 (1) Paragraph 4(1)(d) of the French version of the Regulations is replaced by the following:

- o) la possession, la destruction ou la prévention de la propagation de tout poisson ou de tout autre organisme aquatique qui cause ou qui pourrait causer des dommages aux poissons;
(5) Paragraph 4(1)(q) of the English version of the Regulations is replaced by the following:
- (q) the information that the master of a fishing vessel shall report from the water, including the method by which, the period in which and the person to whom the report is to be made.
(6) Paragraph 4(4)(a) of the English version of the Regulations is replaced by the following:
- (a) if the licence holder consents to receiving it by electronic means, on the day recorded by the server of the provincial Minister as the time of sending it;
6 Subsection 6(1) of the Regulations is replaced by the following:
6 (1) No person shall possess, transport or release members of an invasive species except in accordance with the Aquatic Invasive Species Regulations or as authorized under a licence issued under subsection (2).
7 (1) Subsection 7(1) of the Regulations is replaced by the following:
7 (1) No person shall fish for or possess a specially protected fish except as authorized under a licence issued under subsection (2).
(2) Paragraph 7(2)(b) of the French version of the Regulations is replaced by the following:

8 (1) Subsection 10(2) of the French version of the Regulations is replaced by the following:

9 (1) Subsection 13(1) of the French version of the Regulations is replaced by the following:

(2) Paragraph 13(2)(c) of the French version of the Regulations is replaced by the following:

10 Section 15 of the French version of the Regulations is replaced by the following:
15 Il est interdit de pêcher à la ligne ou de prendre à la ligne et de garder des poissons d’une espèce mentionnée à la colonne 1 de l’annexe 2 dans les eaux visées à la colonne 2 pendant la période indiquée à la colonne 3.
11 Section 19 of the French version of the Regulations is replaced by the following:
19 Il est interdit de prendre et de garder, dans une même journée, dans les eaux visées à la colonne 2 de la partie 3 de l’annexe 3, des poissons d’une espèce mentionnée à la colonne 3, en quantité excédant le contingent fixé à la colonne 4 ou d’une taille qui n’est pas conforme à la limite qui y est fixée, selon le type de permis visé à la colonne 1.
12 Section 21 of the Regulations is replaced by the following:
21 No non-resident shall catch and retain in any one day or possess fish of a species set out in column 3 of Part 5 of Schedule 3 as specified for the type of licence set out in column 1 from the waters set out in column 2 in an amount that exceeds the quota or of a size that does not comply with the size limit set out in column 4.
13 Section 23 of the French version of the Regulations is replaced by the following:
23 (1) La personne qui pêche à la ligne à partir d’un bateau de pêche au titre d’un permis de pêche sportive ou d’un permis de pêche écologique et qui prend de l’achigan à grande bouche, de l’achigan à petite bouche, du doré jaune ou du grand brochet peut échanger un ou plusieurs poissons vivants de ces espèces qu’elle a pris contre d’autres des mêmes espèces, si les conditions suivantes sont réunies :
- a) le poisson vivant pris et non remis immédiatement à l’eau est retenu dans un vivier aéré mécaniquement en tout temps;
- b) le poisson vivant pris est remis à l’eau dans les eaux où il a été pris et survivra à la remise.
(2) La personne pêchant au titre d’un permis de pêche sportive peut retenir dans un vivier au plus six achigans à petite bouche ou à grande bouche.
14 Subsection 25(2) of the Regulations is replaced by the following:
(2) For the purposes of subsection (1), paragraphs 29(2)(d) and 31(3)(c) and sections 38 and 42, Lake Nipigon and its tributaries include the waters described in item 3, column 2 of Part 1 of Schedule 4.
15 Section 26 of the English version of the Regulations is replaced by the following:
26 No person shall possess a live fish, other than a baitfish, caught by angling from the following waters in Zone 4: Lac Seul, Broad Lake, Sunlight Lake and all connecting waters, Abram Lake, Botsford Lake, Duck Lake, Hidden Lake, Minnitaki Lake, Pelican Lake and all connecting waters, waters collectively known as the Rice River, including Flower Lake, Parnes Lake, Twill Lake, Twin Bay of Minnitaki Lake, Twin Flower Lake, Twin Flower Creek and all connecting streams.
16 Section 28 of the French version of the Regulations is replaced by the following:
28 Il est interdit de remettre à l’eau de l’appât ou du poisson-appât vivant ou de déverser le contenu d’un seau ou autre contenant amovible utilisé pour en retenir, dans toutes eaux ou à moins de 30 m d’un plan d’eau.
17 (1) Paragraph 29(2)(a) of the French version of the Regulations is replaced by the following:

- (c) fishing for rainbow smelt by means of a dip net or seine net; or

- (a) catch and retain in any one day or possess fish of a species set out in column 1 of Part 1 of Schedule 6 from the waters set out in column 3 in an amount that exceeds the quota set out in column 5 or 6, as the case may be;
21 (1) Subsection 36(1) of the Regulations is replaced by the following:
36 (1) No person who is sport fishing by a means other than angling shall
- (a) subject to section 28.1, catch and retain in any one day or possess more baitfish than the quota set out in column 5 of Part 2 of Schedule 6;
- (b) when fishing for baitfish, use any gear other than the gear set out in column 2 of Part 2 of Schedule 6; or
- (c) fish for baitfish during the close time set out in column 4 of Part 2 of Schedule 6.
(2) Subsection 36(2) of the French version of the Regulations is replaced by the following:

26 Section 42 of the Regulations is replaced by the following:
42 (1) No person who is fishing under a commercial fishing licence shall set or use a hookline or net unless
- (a) a buoy, marker or stake is attached to the hookline or to each end of the net;
- (b) each buoy, marker or stake is legibly marked with the licence holder’s name or licence number; and
- (c) the licence holder’s name or licence number is visible without raising the gear from the water.
(2) Despite paragraph (1)(a), and except in the case of ice fishing,
- (a) in the waters of Lake of the Woods and Shoal Lake, the hookline or each end of the net must be marked by a buoy with a shaft whose upper extremity is at least 53 cm above the water and has attached to it an orange flag measuring at least 22 cm by 22 cm; and
- (b) in the waters of Lake Superior and Lake Nipigon and its tributaries, the hookline or each end of the net must be marked by a standard marker ball 50 cm in diameter or by a buoy with a shaft whose upper extremity is at least 92 cm above the water and has attached to it an orange flag measuring at least 22 cm by 22 cm.
27 (1) The portion of subsection 44(1) of the French version of the Regulations before paragraph (a) is replaced by the following:

REGULATORY IMPACT ANALYSIS STATEMENT

Issues
The Standing Joint Committee for the Scrutiny of Regulations (SJCSR) has identified a number of technical issues with the Ontario Fishery Regulations, 2007 and has recommended that these Regulations be amended to address these issues. In addition, through experience in application of the Regulations to date, minor errors were detected, or certain provisions have become outdated, which also require amendment. There are also minor technical amendments to the Ontario Fishery Regulations, 1989.
The regulatory amendments will ensure that the regulations are accurate, and operate as intended.
Objectives
The amendments have the following objectives:
- to correct typographical or grammatical errors;
- to correct discrepancies between the French and English versions;
- to improve consistency in terminology;
- to update terminology;
- to add clarity to a regulatory provision; and
- other miscellaneous changes: to update the name of a provincial ministry; to resolve discrepancies in names and coordinates, etc.
Description
The amendments made are minor and administrative in nature.
A. Amendments to the Ontario Fishery Regulations, 2007
1. The following amendments correct typographical or grammatical errors:
- Subsection 1(1) (French): In the definition of the word “vivier” a comma has been added and the word “et” has been removed.
- Paragraph 2(2)(d) (English): The spelling of “aquaculture” has been corrected.
- Paragraph 2(2)(d) (French): The term “d’eaux” has been changed to “d’eau” and subsequent words have been changed to agree grammatically with the new term.
- Paragraph 4(1)(f) (English): The phrase “the type, size, quantity or manner of marking fishing gear or equipment” has been changed to “the type, size, quantity or marking of fishing gear or equipment.”
- Paragraph 4(1)(g) (French): The phrase “ces engins” has been changed to “les engins.”
- Paragraph 4(1)(m) (French) [two changes]: A comma has been added. The last instance of the word “ou” has been changed to “et.”
- Paragraph 4(1)(n) (French): The sentence structure has been corrected.
- Paragraph 4(1)(o) (French) [three corrections]: Wording and sentence structure have been altered to improve grammar and better align with the English version.
- Paragraph 4(4)(a) (English): A space has been added to the word “theserver” making the phrase “the server.”
- Subsection 13(1) (French): The word “fixé” has been removed.
- Section 15 (French): The words “un poisson” have been replaced with “des poissons.”
- Section 19 (French): The phrase “à quiconque pêche” has been removed from the phrase “Il est interdit à quiconque pêche de prendre et de garder.”
- Section 21 (French) [five corrections]: The word “un” has been removed from between “tout” and “non-résident” in the phrase “Il est interdit à tout un non-résident.” The second occurrence of the phrase “dans les eaux visées à la colonne 2 de la partie 5 de l’annexe 3” has been removed as this information is not required twice. The phrase “dans une même journée” has been moved to earlier in the sentence. The phrase “ou d’avoir en sa possession des poissons” has been changed to “ou d’avoir en sa possession de tels poissons.” The word “prévue” has been changed to “fixée.”
- Section 21 and paragraph (35)(2)(a) (English) [two corrections]: In both places, the word “more” has been removed from the phrase “or possess more fish of a species.”
- Section 28: The phrase “un sceau” has been corrected to “un seau.”
- Subparagraph 29(2)(c)(i) (French) [two corrections]: A comma has been added between the “O)” and “de la baie” in the phrase “(49°42′ N, 94°45′ O), de la baie Echo.” A close bracket has been added between “O” and “ou du lac Cul” in the phrase “(49°39′ N, 94°50′ O) ou du lac Cul de Sac.”
- Paragraph 31(3)(b) (French): The extra “la” has been removed in the phrase “dans les eaux visées à la la partie.”
- Paragraph 36(1)(a) (English) [two changes]: The word “caught” has been removed from the phrase “or possess, more baitfish caught than the quota.” Two commas were removed.
- Paragraph 36(1)(b) (English): The word “in” has been added in the phrase “set out in column 2.”
- Paragraph 36(1)(c) (French): The words “de fermeture” have been added in the phrase “durant la période de fermeture indiquée à la colonne 4.”
- Paragraph 37(2)(b) (French): The words “au sceau” have been replaced with “un seau.”
- Subsection 38 (1) (French) [two changes]: The phrase “ou corde” has been changed to “ou une corde.” The article “un” has been added before “réservoir.”
- Paragraph 41(2)(b) (French): The phrase “de l’eau” has been moved from the end of the sentence to after the word “retirer.”
- Subsection 44(1) (French): A comma was removed after the word “règlement.”

- Schedule 4, Part 7, paragraph 2(a) (English): Capitals have been removed from the phrase “Inner Harbour Light.”
- Schedule 4, Part 7, item 2(a) (French) [two changes]: The word “située” has been changed to “situé” to agree grammatically with the word “havre” earlier in the sentence. A semicolon was added at end of the paragraph.
- Schedule 5, Part 1, subitem 6(1), column 2 (English); Schedule 5, Part 1, subitem 6(1), column 3 (English and French): The word “MacKlem” was corrected to “Macklem.”
- Schedule 5, Part 2, item 1, column 2 (French): The “(1)” before the phrase “Du 1er janvier” has been removed.
- Schedule 5, Part 1, item 5(4) (English): The abbreviation “Twp.” has been changed to “Township.”
- Schedule 6, Part 1, item 3 (English): The “(1)” in columns 3 to 6 has been removed, as there is no subitem (2).
- Schedule 6, Part 1, item 3 (French): A comma has been removed after the number 20, and the word “et” has been added.
- Schedule 6, Part 1, item 3 (English): The “and” before “Algonquin” has been replaced with a comma.
- Schedule 8, item 5 (English): The dash in “bait-fish” has been removed.
2. The following amendments correct discrepancies between the French and English versions:
- Subsection 1(1) (French): The English and French definitions of “livewell”/“vivier” were not consistent. The French definition has been changed to align with the English definition: the livewell must contain no less than 46 litres of water (instead of only requiring the capacity to hold that much water). The words “d’eau” were added to the French.
- Subsection 1(1) and Schedule 6, Part 1, item 6 (French and English) [multiple changes]: There was inconsistency between French and English versions on the definition of “spear gun” / “fusil à harpon”: the English definition excluded a bow, whereas the French definition excluded both a bow and a crossbow. The term “arbalète” has been removed from the French in subsection 1(1). In Schedule 6, Part 1, item 6, the phrase “(includes all longbows and crossbows)” has been removed from the English and the phrase “(comprend tous les grands arcs et arbalètes)” has been removed from the French.
- Paragraph 4(1)(k) (French): The English authorizes the Minister to specify terms and conditions respecting the information kept and recorded; whereas the French did not. The French has been changed to align with the English.
- Paragraph 4(1)(q) (English): The English required the Minister to specify a specific time at which the master of a vessel is to make a report; the French required the Minister to specify the amount of time given to make the report. The English has been changed to align with the French. The word “fishing” has also been added before “vessel.”
- Paragraph 7(2)(b) (French): The English referred to the particular species for which the licence was issued; the French referred to species of fish in general. The French has been amended to align with the English.
- Subsection 7(3) (English): The English required a person possessing an American Eel to provide documentary evidence that the eel was lawfully obtained outside of Ontario (although it did not specify to whom the documentary evidence must be provided); the French merely required the person to have the necessary documentation. The English has been amended to align with the French.
- Subsection 13(1) (French): The English referred to closing an area; the French referred to closing a “zone.” The French has been amended to align with the English.
- Paragraph 13(2)(c) (French): The English required the notice of a variation in a close time, fishing quota or limit on the size of fish to be posted “in the area or in the vicinity of the area affected by the variation”; the French required the notice to be posted “dans la zone en cause ou dans la zone avoisinante.” The French has been amended to be consistent with the English.
- Paragraph 13(2)(f) (French): Capitals have been removed from the word “Résumé” in “le résumé des règlements…” so that neither the French nor the English refer to a proper name.
- Section 15 (French): The French has been amended to align with the English, which specifies catching fish by angling.
- Paragraph 23(1)(a) (French): The word “vivant” has been moved earlier in the sentence to better align with the English.
- Paragraph 23(1)(b) (French): The French has been amended to align with the English, so that the standard in both languages is that the fish will survive after release from a livewell. Previously, the French standard was that the fish may survive after release from a livewell.
- Subsection 23(2) (French): The French has been amended to align with the English, which refers to a person fishing under a sport-fishing licence. Previously, the French referred to the licence holder.
- Section 26 (English): The English has been amended to align with the French. Now neither language indicates that Broad Lake is part of Lac Seul.
- Paragraph 29(2)(a) (French): The French has been amended to align with the English. Both now refer to live baitfish rather than baitfish.
- Subsection 29(4) and paragraph 39(4)(a) (English): The capital letters in the English phrase “Licence to Collect Fish for Scientific Purposes” have been removed. It now aligns with the French.
- Paragraph 31(4)(a) (English): The English “single barbless hook” has been amended to “single-pointed barbless hook” to align with the French.
- Paragraph 34(2)(c) (English): The English has been amended to include the word “rainbow” in front of the word “smelt.” It now aligns with the French version.
- Subsection 38(1) (French): The word “autre” has been removed from the phrase “un dispositif de capture ou autre réservoir” to align with the English version that does not refer to any “other” type of “live holding box.”
- Subsection 41(2) and paragraph 41(2)(b) (French): The French has been amended so that where the English refers to a “live holding box” the French refers to “un réservoir.”
- Subsection 44(1) (French): The French has been amended to align with the English. It now precludes a person who purchases fish for the purpose of resale from being designated an observer.
- Paragraph 44(4)(a) (English): The English has been amended to align with the French. It now requires a person operating a vessel to permit an observer to board in order to perform the actual duties assigned to the observer (rather than any of the duties described in subsection (1)).
- Schedule 3, Part 1, subitems 1(11), 11(1) and 13(1); Schedule 3, Part 3, items 7 and 8, column 4; Schedule 3, Part 5, item 3, column 4, subitem “c” (French): The French has been amended so that ranges are described in a consistent manner that aligns with the English (e.g. “de moins de 33 cm ou de plus de 40 cm”).
- Schedule 3, Part 1, subitem 4(3), columns 3 and 4; Schedule 3, Part 1, subitem 5(3), columns 3 and 4; Schedule 3, Part 1, subitem 6(3), columns 3 and 4; Schedule 3, Part 1, subitem 9(3), column 3; Schedule 3, Part 1, subitem 11(1), columns 3 and 4; Schedule 3, Part 1, subitem 13(1), columns 3 and 4; Schedule 3, Part 1, subitem 14(1), columns 3 and 4; Schedule 3, Part 3, paragraph 7(a), column 4; Schedule 3, Part 5, paragraph 3(c), column 4: In the French version of the Regulations, the word “et” has been replaced with the word “dont.”
- Schedule 3, Part 1, subitems 3(3) and 10(3) (French): For the conservation fishing licence, the French has been amended from “2, dont seulement un d’au plus 61 cm et aucun de plus de 86 cm” to “2, dont seulement un de plus de 61 cm et aucun de plus de 86 cm” to align with the English.
- Schedule 3, Part 1, subitem 14(3) (French): The French has been amended from “2, dont seulement un de plus de 61 cm et aucun de plus de 86 cm” to “2, dont seulement un de plus de 86 cm” to align with the English.
- Schedule 3, Part 3, paragraph 8(a) (French): The French has been amended to align with the English, which refers to Walleye and Sauger or any combination. Previously, the French did not specify “any combination.”
- Schedule 4, Part 1, heading (French): The French heading has been amended to “Restrictions relatives aux engins de pêche à la ligne” in order to align with the English heading “Angling Gear Restrictions.”
- Schedule 4, Part 7, paragraph 2(a) (French) [two changes]: The phrase “à la bouée de l’arrière-port” has been changed to “au feu du havre intérieur” to align with the English phrase “inner harbour light.” The word “autre” has been removed.
- Schedule 5, Part 1, subitem 3(2) (English): The English has been amended to refer to “upstream” of Ash Rapids, rather than “above” Ash Rapids, to align with the French.
- Schedule 5, Part 1, subitem 5(4), column 2 (French): The French reference to the Thunder Bay – Algoma District Boundary has been amended to refer to a boundary between two distinct districts. It now aligns with the English.
- Schedule 5, Part 1, subitem 7(5) (French) [two changes]: The phrase “Lac Supérieur, Parc provincial et cantons avoisinants” in column 1 has been amended to “Parc provincial du lac Supérieur et les cantons avoisinants.” The phrase “Toutes les eaux des cantons Parc provincial du lac Supérieur et des cantons avoisinants de Redsky” in column 2 has been amended to “Toutes les eaux qui se trouvent dans les limites du Parc provincial du lac Supérieur et des cantons avoisinants de Redsky” to reflect that the Park is not in a township. The French now aligns with the English.
- Schedule 5, Part 2, heading (French): The French heading has been amended to “Périodes pendant lesquelles il est interdit d’utiliser du poisson comme appât ou d’en avoir en sa possession à cette fin” in order to align with the English heading “Periods during which use or possession of fish for use as bait is prohibited.”
- Schedule 6, Part 1, item 2 (French): The term “arc” has been replaced with “arc et flèche” to align with the English term “bow and arrow.”
3. The following amendments improve consistency in terminology:
- Subsection 1(1) (French): In the definition of “pêche sportive” the word “Capture” was amended to “Prise” for consistency throughout the Regulations.
- Paragraphs 4(1)(d), (j) and (l); paragraph 23(1)(b); subsection 23(2); section 28; subsection 38(2) (French): The verb “garder” has been amended to “retenir” to be consistent throughout the Regulations.
- Paragraphs 4(1)(f), (g) and (m) (French): The phrase “matériel de pêche” has been amended to “équipement(s) de pêche” to maintain consistency with the Fisheries Act and subparagraph 44(4)(b)(v) in the Regulations.
- Section 10 (French and English): The English previously used “on any waters” and “in any waters” and the French version used phrases “dans l’eau”, “sur l’eau” and “dans toutes eaux.” The English has been amended to use “in any waters” in subsection 10(3) and the French has been amended to use “dans l’eau” in subsections 10(2) and 10(3).
- Sections 23 and 28 (French): To maintain consistency throughout the Regulations, the French translation of “catch” has been amended to “prendre” (instead of “capturer”) and “hold” to “retenir” (instead of “garder”).
- Subsection 29(3) (French): The word “capturées” has been amended to “prises” to be consistent throughout the Regulations.
- Subsection 38(1) (French): The phrase “Il est interdit à la personne qui pratique la pêche sportive…” has been amended to “Il est interdit à quiconque pratique la pêche sportive…” for consistency throughout the Regulations.
- Section 42 (French): The words “en vertu” have been changed to “au titre” for consistency throughout the Regulations.
- Schedule 4, Part 1, item 3, column 2 (French): The French has been amended to use consistent terminology for the English term “tributaries” instead of using both “tributaires” and “cours d’eau tributaires.”
- Schedule 6, Part 1, item 2, column 3 (English): The words “other than” have been changed to “excluding” for consistency throughout the Schedule.
- Schedule 8, item 3 (French): The French term “chatte de l’est” has been amended to “Méné jaune”, which is the common name for Golden shiner.
4. The following amendments update terminology:
- Paragraph 29(2)(d) (French and English): In English, the phrase “Lake Nipigon and its tributaries and the waters on the islands of Lake Nipigon” is replaced by “Lake Nipigon and its tributaries”; in French, the phrase “du lac Nipigon et de ses tributaires et des îles du lac Nipigon” is replaced by “du lac Nipigon et de ses tributaires.”
- Schedule 1, Part 1, subitem 34(a) (French): The term “saumon chinook” has been replaced with “saumon quinnat” to align with usage in Schedule 2, item 13 and in accordance with precedents in the statute book and preferences indicated by Termium and the Office québécois de la langue française.
- Subsection 36(2), Schedule 1, Part 2, item 2 and Schedule 7, item 9 (French): The term “Meuniers” has been replaced with “Catostome” (the common name for the family of Catostomidae, as established in Schedule 1, Part 1, item 45).
5. The following amendments add clarity to a regulatory provision:
- Subsection 4(1)(q) (English): The word “fishing” has been added between “a” and “vessel.”
- Subsection 7(1) (English): The phrase “without a license” has been changed to “except as authorized under a license.”
- Subsection 7(1) (French): The phrase “sans être titulaire d’un permis” has been changed to “à moins d’y être autorisé par un permis.”
- Paragraph 23(1)(b) (French): The word “vivant” has been added.
- Subsection 29(3) (French) [four changes]: The word “posséder” has been changed to the phrase “avoir en sa possession.” The words “leur utilisation” have been changed to “les utiliser.” The phrase “celles-ci” has been changed to “ces écrevisses.” The phrase “se livre à cette activité” has been replaced with the word “pêche.”
- Subsection 31(5) (English and French): Both the English and French have been amended to clarify that both Clearwater Bay and Echo Bay are part of Lake of the Woods, while Cul de Sac Lake is separate.
- Subsection 36(2) (French) [two changes]: The words “autrement qu’à la ligne, ou de prendre et de garder du poisson-appât” have been re-ordered to “ou de prendre et de garder du poisson-appât, autrement qu’à la ligne.” The phrase “autre que du cisco” has been replaced with “à l’exception du cisco.”
- Subsection 38(1) (English): The word “retaining” has been changed to “holding.”
- Subsection 38(1) (French): The word “un” has replaced the word “autre” before the word “réservoir.”
- Paragraph 39(3)(b) (French): The French word “conservation” when referring to “storage” in English, has been replaced with the word “entreposage.”
- Section 42 (English and French): Both the English and French have been amended to clarify that a marker or stake may be used instead of a buoy to mark the hookline or each end of the net, and to clarify how the buoy, marker or stake must be marked. Additional changes in wording and word order also improve clarity: e.g. in French, “sphère indicatrice de modèle courant” was changed to “boule de repérage standard.”
- Schedule 4, Part 1, item 3, column 2 (English and French): In order to increase clarity, changes were made to how Lake Nipigon and its tributaries are referred to.
- Schedule 4, Part 7, paragraph 4(f) (English and French): The reference to Jordan Harbour has been removed from the list of exclusions in Zone 20, since Jordan Harbour is not even in Zone 20.
- Schedule 5, Part 1, subitem 5(4), column 2 (English): The English has been amended to reflect that there should be no use or possession of live baitfish in the waters of Pukaskwa National Park. It now aligns with the French.
- Schedule 6, Part 1, item 2, column 3; Schedule 6, Part 1, item 5, column 3; Schedule 6, Part 1, item 6, column 3 (English and French): The word “waters”/“eaux” was replaced with “zones”/“zones.”
6. The following amendments make other miscellaneous changes:
- Subsection 1(3) (English and French): This subsection previously referred to common names for a species or group of species of fish contained in Part 1 of Schedule 1. Both the English and French have been amended to refer to Parts 2 and 4 of Schedule 1, as well, given that these parts also contain common names.
- Subsection 6(1) (English and French): This section has been amended from “No person shall possess, transport or release members of an invasive species without a licence issued under subsection (2)” / “Il est interdit à quiconque d’avoir en sa possession, de transporter ou de remettre à l’eau un organisme faisant partie d’une espèce envahissante sans être titulaire d’un permis délivré en vertu du paragraphe (2)” to “No person shall possess, transport or release members of an invasive species except in accordance with the Aquatic Invasive Species Regulations or as authorized under a licence issued under subsection (2)” / “Il est interdit d’avoir en sa possession, de transporter ou de remettre à l’eau un organisme faisant partie d’une espèce envahissante, sauf en conformité avec le Règlement sur les espèces aquatiques envahissantes ou à moins d’y être autorisé par un permis délivré en vertu du paragraphe (2).” This corrects an inadvertent expansion of prohibitions that occurred as a result of consequential changes made to the Ontario Fishery Regulations, 2007 by the Aquatic Invasive Species Regulations. For example, the consequential changes resulted in prohibiting the possession of round goby in any form (i.e. living or non-living), even though round goby can be possessed under the Aquatic Invasive Species Regulations, if dead.
- Subsection 25(2) (English and French): An amendment has been made for consistency in references to Lake Nipigon. Subsection 25(2) previously stated “For the purposes of subsection (1), paragraph 31(3)(c) and sections 38 and 42, Lake Nipigon and its tributaries include the waters described in item 3, column 2 of Part 1 of Schedule 4.” Subsection 25(2) has been modified to include paragraph 29(2)(d) as well, which also refers to Lake Nipigon.
- Subsection 31(4) (English and French): The coordinates for Red Lake have been corrected to 51°03′00″ N, 93°57′00″ W.
- Subsection 36(1) (English and French): This subsection has been amended to clarify that subsection (1) only applies to persons sport fishing by a means other than by angling. The phrase “by a means other than by angling” and its French equivalent have been added to subsection 36(1) and removed from paragraphs 36(1)(a) and (c).
- Schedule 3, Part 1, subitems 1(12) and 12(6) (English and French): These items set out a number of fish without any restriction on the size of the fish. Elsewhere in the Regulations where there are no restrictions on size, the number of fish is specified followed by “any size” / “de toute taille.” The terms “any size” / “de toute taille” have been added here for clarity and for consistency with other parts of the Regulations.
- Schedule 3, Part 3, item 2; Schedule 4, Part 3, subitem 1(1), column 2; and Schedule 5, Part 2, item 1 (English and French): Corrections have been made to the spelling of “Atikaminike Bay” / “baie Atikaminike” and to its coordinates (49°14′ N, 94°04′ W); to the coordinates for Willow Bay (49°25′ N, 94°04′ W); and to the coordinates for Sammons Bay (49°23′45″ N, 93°59′28″ W).
- Schedule 5, Part 1, subitems 9(38) and 9(39) (English and French): The coordinates for Long Lake have been corrected. The coordinates for the Long Lake referred to in subitem 9(38) have been corrected to 45°51′03.28″ N, 79°11′22.35″ W; the coordinates for the Long Lake referred to in subitem 9(39) have been corrected to 45°49′47.71″ N, 79°15′32.68″ W.
- Schedule 6, Part 1, item 2, column 3 (French); Schedule 6, Part 1, item 3, column 3 (English); Schedule 6, Part 1, item 4, column 3 (English); Schedule 6, Part 1, item 5, column 3 (English); Schedule 6, Part 1, item 6, column 3 (English): The phrases “the waters in” / “the waters set out in” / “les eaux du” have been removed due to redundancy, as the column title is “Waters”/“Eaux.”
- Schedule 6, Part 1, item 3 (English and French): Previously, this item excluded the waters of Zone 16 and Lake Simcoe in Zone 16, which was redundant. The reference to Lake Simcoe has been removed.
- Schedule 6, Part 1, item 7, column 2 (English and French): The gear “Dip net, baitfish trap and by hand” / “Épuisette, piège à poisson-appât et à la main” has been replaced by “Baitfish trap and dip net” / “Épuisette et piège à poisson-appât.” The gear “by hand” / “à la main” has been removed because section 14 does not identify “by hand” / “à la main” as a non-angling method that can be used.
- Paragraphs 2(2)(c) and 13(2)(f); and subsection 3(2) (English and French): The name “Ontario Ministry of Natural Resources” / “ministère des Richesses naturelles de l’Ontario” has been amended to “Ontario Ministry of Natural Resources and Forestry” / “ministère des Richesses naturelles et des Forêts de l’Ontario” to reflect its current name.
B. Amendments to the Ontario Fishery Regulations, 1989
1. The following amendments correct typographical or grammatical errors:
- Schedule 5, subitems 1(1), 1(2), 1(4) and 1(5) (English): The letter “c” in the word “commencing” has been changed from uppercase to lowercase.
- Schedule 5, subitem 1(1) (French) [three corrections]: The phrase “tel qu’indiqué sur” has been changed to “comme l’indique” (two instances). The words “qui est” have been added before “située” (two instances). The word “de” has been added four times in the descriptions of the latitude and longitude coordinates for Pottahawk Point and Turkey Point Marina, specifically in the phrases “coordonnées sont de” (two instances) and “et de” (two instances).
- Schedule 5, subitem 1(2) (French) [two corrections]: The word “à” has been replaced by the phrase “sur une distance de” (two instances). The phrase “le long de ce bord” has been replaced with “le long du bord.”
- Schedule 5, subitem 1(4) (English): A comma has been removed.
- Schedule 5, subitem 1(5) (English) [two changes]: The word “thence” has been replaced with the word “then.” The word “the” has been added between the words “place” and “beginning.”
2. The following amendments correct discrepancies between the French and English versions:
- Schedule 5, subitem 1(1) (French): The word “située” has been removed.
3. The following amendments improve consistency in terminology:
- Schedule 5, subitem 1(1) (French): The words “en direction du sud” have been replaced with “vers le sud.”
4. The following amendments add clarity to a regulatory provision:
- Schedule 5, subitems 1(1), 1(2) and 1(5) (French): The phrase “commençant au point” has been changed to “à partir du point.”
- Schedule 5, subitem 1(1) (English and French): Unnecessary inclusion of the words “latitude” and “longitude” prior to geographic coordinates have been removed (two instances).
- Schedule 5, subitem 1(2) (English and French): The distance “1 000 m” has been replaced with “1 km.”
- Schedule 5, subitem 1(2) (English): The words “thence westerly along the said” have been removed.
- Schedule 5, subitem 1(4) (English and French): The phrase “to the place of beginning” / “jusqu’au point de départ” was added at the end of the description in column 1.
- Schedule 5, subitem 1(5) (English and French): The distance “1 250 m” has been changed to “1.25 km.”
- Schedule 5, subitem 1(5) (English and French): Four sets of latitude and longitude coordinates were added to the description in column 1 in order to clarify geographic references. To further specify geography, several site references were added (e.g. Stonemill Road, Rosehill Road).
- Schedule 5, subitem 1(5) (French): Commas were added and the word “dans” was removed in the phrase which now reads: “Fort Érié, municipalité régionale de Niagara, situées.”

- Schedule 5, subitem 1(1) (English and French): The name “Ontario Ministry of Natural Resources” / “ministère des Richesses naturelles de l’Ontario” has been amended to “Ontario Ministry of Natural Resources and Forestry” / “ministère des Richesses naturelles et des Forêts de l’Ontario” to reflect its current name (two instances).
- Schedule 5, subitems 1(2), 1(4) and 1(5) (English and French): The references to marine buoys have been replaced with a description and UTM coordinates. The existing boundary remains as is, but using the UTM coordinates will ensure that the boundaries are known in the event that a buoy is lost or cannot be placed in the water.

The “One-for-One” Rule does not apply to these amendments, as there is no change in administrative costs or burden to business.
Small business lens footnote 4
The small business lens does not apply to these amendments, as there are no costs to small business.
Consultation
Fisheries and Oceans Canada worked closely with the Ontario Ministry of Natural Resources and Forestry in the development of these amendments. No additional consultations were undertaken, as the amendments are minor and technical in nature and serve to correct errors and increase clarity.
Rationale
The amendments are in response to the SJCSR’s review of the Regulations and minor technical amendments identified by the Ontario Ministry of Natural Resources and Forestry. The amendments help to correct and improve the Regulations, and do not impose any costs on the government or stakeholders.
