Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraphs 320.38(b) to (d)^{footnote a} of the Criminal Code^{footnote b}, makes the annexed Regulations Amending the Blood Drug Concentration Regulations.

Regulations Amending the Blood Drug Concentration Regulations

Amendments

1 Section 1 of the Blood Drug Concentration Regulations^{footnote 1} is replaced by the following:

Summary offence

1 For the purpose of subsection 320.14(4) of the Criminal Code, the prescribed blood drug concentration for tetrahydrocannabinol (THC) is 2 ng of THC per mL of blood.

2 The portion of section 2 of the Regulations before the table is replaced by the following:

Hybrid offence — drugs

2 For the purpose of paragraph 320.14(1)(c) of the Criminal Code, the prescribed blood drug concentration for each drug set out in column 1 of the table to this section is set out in column 2.

3 Section 3 of the Regulations is replaced by the following:

Hybrid offence — combination of drugs and alcohol

3 For the purpose of paragraph 320.14(1)(d) of the Criminal Code, the prescribed blood alcohol concentration is 50 mg of alcohol per 100 mL of blood and the prescribed blood drug concentration for tetrahydrocannabinol (THC) is 2.5 ng of THC per mL of blood.

Coming into Force

December 18, 2018

4 These Regulations come into force on December 18, 2018.
