FARM PRODUCTS AGENCIES ACT

Whereas the Governor in Council has, by the Canadian Hatching Egg Producers Proclamation footnotea, established the Canadian Hatching Egg Producers (“the Agency”) pursuant to subsection 16(1)footnoteb of the Farm Products Agencies Act footnotec;

Whereas that Agency has been empowered to implement a marketing plan pursuant to that Proclamation;

Whereas the proposed Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order is an order of a class to which paragraph 7(1)(d)footnoted of that Act applies by reason of section 2 of the Agencies’ Orders and Regulations Approval Order footnotee, and has been submitted to the National Farm Products Council pursuant to paragraph 22(1)(f) of that Act;

And whereas, pursuant to paragraph 7(1)(d)footnoted of that Act, the National Farm Products Council has approved the proposed Order after being satisfied that it is necessary for the implementation of the marketing plan that that Agency is authorized to implement;

Therefore, the Canadian Hatching Egg Producers, pursuant to paragraphs 22(1)(f) and (g)footnotef of the Farm Products Agencies Act footnotec and section 8 of the schedule to the Canadian Hatching Egg Producers Proclamation footnotea, makes the annexed Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order.

Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order

Amendments

1 (1) Paragraph 2(1)(b) of the Canadian Broiler Hatching Egg Marketing Levies Order footnote1 is replaced by the following:

(2) Subsections 2(2) and (3) of the Order are replaced by the following:

(2) A levy is imposed on a producer, dealer or hatchery operator in a non-signatory province of $0.0126257 per broiler hatching egg produced in any non-signatory province and marketed by that producer, dealer or hatchery operator in interprovincial trade into a signatory province.

(3) Subsections (1) and (2) cease to have effect on June 23, 2019.

Coming into Force

2 This Order comes into force on the day on which it is registered.

EXPLANATORY NOTE

(This note is not part of the Order.)

The amendments set the levies imposed on producers in Quebec for broiler hatching eggs marketed by those producers in interprovincial or export trade. The amendments also increase the levy on producers, dealers and hatchery operators in non-signatory provinces for broiler hatching eggs marketed in interprovincial trade into signatory provinces, and establish June 23, 2019, as the day on which subsections 2(1) and (2) of the Order cease to have effect.
