CANADA NOT-FOR-PROFIT CORPORATIONS ACT

Order Fixing December 31, 2017 as the Day on which Certain Provisions of the Act Come into Force

Whereas subsection 114(4) (see footnote a) of the Canada Pension Plan (see footnote b) provides that where any enactment of Parliament contains any provision that alters, or the effect of which is to alter, either directly or indirectly and either immediately or in the future, any of the matters referred to in that subsection, it shall be deemed to be a term of that enactment, whether or not it is expressly stated in the enactment, that the provision shall come into force only on a day to be fixed by order of the Governor in Council, which order may not be made and shall not in any case have any force or effect unless the lieutenant governor in council of each of at least two thirds of the included provinces, having in the aggregate not less than two thirds of the population of all the included provinces, has signified the consent of that province to the enactment;

Whereas subsection 317(2) of the Canada Not-for-profit Corporations Act, chapter 23 of the Statutes of Canada, 2009, amends the Canada Pension Plan Investment Board Act (see footnote c);

And whereas the lieutenant governors in council of at least two thirds of the included provinces, having in the aggregate not less than two thirds of the population of all the included provinces, have signified the consent of those provinces to that amendment;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Industry, pursuant to section 372 of the Canada Not-for-profit Corporations Act, chapter 23 of the Statutes of Canada, 2009, fixes December 31, 2017 as the day on which paragraphs 313(a), (b), (d), (f), (h), (j), (l), (n), (p), (r), (s), (u), (w), (y), (z.01), (z.03), (z.05) to (z.09), (z.2), (z.3), (z.7) and (z.9) and subsection 317(2) of that Act come into force.

EXPLANATORY NOTE

The Order in Council fixes the coming-into-force day for the following provisions of the Canada Not-for-profit Corporations Act that have not yet come into force: paragraphs 313 (a), (b), (d), (f), (h), (j), (l), (n), (p), (r), (s), (u), (w), (y), (z.01), (z.03), (z.05) to (z.09), (z.2), (z.3), (z.7), and (z.9) and subsection 317(2).

The coming-into-force date will be December 31, 2017, which is the day after the regulations under the Canada Corporations Act are repealed.

Once in force, these provisions will repeal the sections of the Canada Corporations Act and bring into force the coordinating amendments to other legislation that refer to the Canada Corporations Act.
