Regulations Amending the Canadian Aviation Regulations (Miscellaneous Program)

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 4.9 (see footnote a) and subsection 7.6(1) (see footnote b) of the Aeronautics Act (see footnote c), makes the annexed Regulations Amending the Canadian Aviation Regulations (Miscellaneous Program).
REGULATIONS AMENDING THE CANADIAN AVIATION REGULATIONS (MISCELLANEOUS PROGRAM)
AMENDMENTS
1. (1) The definition “vol” in subsection 101.01(1) of the French version of the Canadian Aviation Regulations (see footnote 1) is replaced by the following:
« vol » Dans le cas d’un ballon libre ou d’un ballon captif, la période comprise entre le moment où le ballon, y compris l’enveloppe et la nacelle, quitte une surface d’appui et le moment de son immobilisation à l’atterrissage. (flight)
(2) The portion of paragraph (c) of the definition “maintenance” in subsection 101.01(1) of the Regulations before subparagraph (i) is replaced by the following:
- (c) work performed on an aircraft by the manufacturer prior to the issuance of whichever of the following documents is issued first:
2. Schedule I of Subpart 3 of Part I of the Regulations is amended by replacing “may be filed with the Registrar, Transportation Appeal Tribunal of Canada” and “from the Registrar” with “may be filed with the Transportation Appeal Tribunal of Canada” and “from the Tribunal”, respectively.
3. The references “Subsection 305.47(1)” and “Subsection 305.47(2)” in column I of Subpart 5 of Part III of Schedule II to Subpart 3 of Part I of the Regulations and the corresponding amounts in column II are replaced by the following:

4. The definition “emergency coordination centre” in section 302.201 of the Regulations is replaced by the following:
“emergency coordination centre” means a designated area to be used in supporting and coordinating emergency operations and whose location is specified under paragraph 302.203(1)(r); (centre de coordination des urgences)
5. Subsection 302.206(2) of the French version of the Regulations is replaced by the following:
(2) Dans le cas d’aéronefs dont la configuration est d’au plus neuf sièges passagers ou qui permettent cette configuration, l’exploitant de l’aéroport peut utiliser, au lieu des diagrammes d’urgence d’aéronefs visés au paragraphe (1), d’autres documents contenant des renseignements équivalents.
6. Paragraph 302.207(2)(b) of the French version of the Regulations is replaced by the following:
- b) ils sont familiarisés avec la marche à suivre relative à la coordination générale des opérations d’urgence sur les lieux d’une urgence;
7. Paragraph 302.302(1)(a) of the French version of the Regulations is replaced by the following:
- a) aux aéroports où ont été effectués, au cours de l’année civile précédente, 2 800 mouvements d’aéronefs commerciaux de transport de passagers qui sont utilisés sous le régime des sous-parties 4 ou 5 de la partie VII;
8. Subsection 302.303(2) of the Regulations is replaced by the following:
(2) Wildlife remains that are found within 200 feet of a runway or an airside pavement area are presumed to be the result of a wildlife strike unless another cause of death is identified.
9. Paragraph 302.307(1)(a) of the Regulations is replaced by the following:
- (a) provide any person who has duties in respect of the airport wildlife management plan with training at least once every five years regarding their assigned duties and the matters set out in section 322.307 of the Airport Standards-Airport Wildlife Planning and Management; and
10. The heading before section 305.05 of the French version of the Regulations is replaced by the following:

11. Paragraph 305.08(1)(c) of the French version of the Regulations is replaced by the following:

12. (1) Subparagraph 305.17(2)(e)(i) of the English version of the Regulations is replaced by the following:
- (i) if a hazardous condition has been identified, have a NOTAM issued identifying the hazard, and
(2) The portion of subsection 305.17(3) of the French version of the Regulations before paragraph (a) is replaced by the following:
(3) Sous réserve du paragraphe (4), l’exploitant d’un héliport doit aviser immédiatement le ministre, et faire en sorte que soit immédiatement avisée l’unité de contrôle de la circulation aérienne ou la station d’information de vol compétente, des circonstances ci-après dont il a connaissance :

(5) Prior to the use of a heliport for helicopter operations, the operator of the heliport shall remove from the surface of the heliport, or from the surrounding ground over which the operator has control, any vehicle or other obstruction that is likely to be hazardous to aviation safety.
13. Paragraph 305.18(1)(a) of the Regulations is replaced by the following:
- (a) provide the Minister with their copy of the heliport operations manual as approved under paragraph 305.08(1)(c) and any amendments to the manual approved under paragraph (2)(b); and
14. Paragraph 305.31(2)(n) of the French version of the Regulations is replaced by the following:
- n) lorsqu’un poste de stationnement d’hélicoptère n’est pas assez grand pour accueillir le plus gros hélicoptère pour lequel l’héliport est conçu ou que les dimensions du poste de stationnement sont limitées par l’espacement minimal par rapport à un obstacle ou à un poste de stationnement voisin, la marque d’indication sur le poste de stationnement d’hélicoptère;
15. (1) Paragraph 305.33(8)(a) of the Regulations is replaced by the following:
- (a) a surface-level heliport unless the FATO and the TLOF are coincidental or the extent of the FATO is conspicuous;
(2) Subsection 305.33(12) of the French version of the Regulations is replaced by the following:
(12) L’exploitant d’un héliport doit, conformément aux exigences de la norme sur les héliports applicable, pourvoir de feux d’axe de voie de circulation toute voie de circulation qui est utilisée dans des conditions de portée visuelle de piste inférieure à 1 200 pieds ou dans des conditions où la visibilité au sol est inférieure à un quart de mille terrestre.
(3) Subsection 305.33(14) of the French version of the Regulations is replaced by the following:
(14) Dans le cas où une aire de trafic est disponible à un héliport qui est certifié comme étant disponible pour utilisation de nuit, l’exploitant de l’héliport doit pourvoir cette aire de feux de bord, de balises rétroréfléchissantes de bord ou de projecteurs d’aire de trafic conformément aux exigences de la norme sur les héliports applicable.
16. (1) Paragraph 305.35(2)(b) of the Regulations is replaced by the following:
- (b) the extent of the FATO and the adjacent ground is not conspicuous.
(2) Paragraph 305.35(3)(a) of the Regulations is replaced by the following:
- (a) the edges of the taxiway are conspicuous;
17. (1) Subsection 305.37(1) of the French version of the Regulations is replaced by the following:
305.37 (1) Sous réserve du paragraphe (4), l’exploitant d’un héliport doit veiller à ce que les obstacles sur les aires de mouvement, de manœuvre ou de sécurité de l’héliport, sauf les aéronefs, soient signalés et éclairés de la façon suivante :
- a) les véhicules et les autres obstacles mobiles sur l’aire de mouvement sont pourvus de marques de façon à être visibles pour les pilotes au cours des manœuvres d’aéronefs;
- b) lorsque l’héliport est utilisé la nuit ou par temps où la visibilité est mauvaise, les véhicules et les autres obstacles mobiles sur l’aire de manœuvre sont pourvus de balises lumineuses;
- c) les feux aéronautiques surélevés au sol sur l’aire de mouvement sont pourvus de marques de façon à être évidents de jour;
- d) conformément à la norme sur les héliports applicable, tout obstacle fixe se trouvant dans l’aire de sécurité est pourvu :
- (i) d’une part, de marques,
- (ii) d’autre part, dans le cas où l’héliport est certifié être disponible pour utilisation de nuit, de balises lumineuses.
(2) Paragraph 305.37(2)(b) of the Regulations is replaced by the following:
- (b) conspicuous by reason of its shape, dimensions or colour;
(3) Subsection 305.37(5) of the Regulations is replaced by the following:
(5) The operator of a heliport shall mark and, if applicable, light an obstacle referred to in subsection (2) unless an aeronautical evaluation determines that
- (a) the obstacle is conspicuous by reason of its shape, dimensions or colour; or
- (b) retro-reflective tape or markers are sufficiently conspicuous to be used instead of lights.
18. Subparagraph 305.55(b)(viii) of the French version of the Regulations is replaced by the following:
- (viii) une attestation signée par le ministre indiquant que le manuel et, le cas échéant, ses modifications ont été approuvés,
19. Section 406.13 of the Regulations is amended by adding “and” at the end of paragraph (f), by striking out “and” at the end of paragraph (g) and by repealing paragraph (h).
20. Section 406.14 of the Regulations is replaced by the following:
406.14 A flight training unit that conducts an integrated course shall establish and maintain a quality assurance program that meets the requirements of section 426.14 of the personnel licensing standards in order to ensure that the flight training unit continues to comply with the conditions and specifications in the flight training unit operator certificate.
21. Section 406.64 of the French version of the Regulations is replaced by the following:
406.64 L’unité de formation au pilotage qui dispense un cours intégré doit remettre à chaque stagiaire ayant réussi ce cours un certificat de réussite au cours qui satisfait aux normes de délivrance des licences du personnel.
22. (1) Paragraph 406.71(2)(d) of the Regulations is replaced by the following:
- (d) each flight instructor who conducts training in accordance with an integrated course shall, before receiving authorization to conduct the training, successfully complete, under the supervision of the chief flight instructor, assistant chief flight instructor or check instructor,
- (i) the indoctrination training referred in paragraph (a),
- (ii) a review of, and a briefing on, the contents of the flight training operations manual and the training manual, and
- (iii) an initial competency check in each type of aircraft in which the flight instructor conducts training in accordance with the integrated course; and
(2) The portion of paragraph 406.71(2)(e) of the French version of the Regulations before subparagraph (i) is replaced by the following:
- e) chaque instructeur de vol qui dispense de la formation conformément au cours intégré doit, tous les 12 mois après celui où la vérification de compétence initiale a été effectuée, réussir, selon le cas :
(3) Subparagraph 406.71(2)(e)(i) of the English version of the Regulations is replaced by the following:
- (i) a recurrent competency check in one of the aircraft in which the flight instructor conducts training in accordance with the integrated course,
23. Section 406.75 of the Regulations is replaced by the following:
406.75 An integrated course shall be conducted under the supervision of the chief flight instructor of a flight training unit that holds a flight training unit operator certificate and shall be arranged by that flight training unit in accordance with the personnel licensing standards.
24. Paragraph 408.17(c) of the French version of the Regulations is replaced by the following:
- c) dans le cas d’un test en vol tenu conformément à l’annexe 8 des normes de tests en vol, le test en vol suivant est tenu au moyen d’un aéronef faisant partie du même groupe que l’aéronef utilisé pour le test en vol initial.
25. Paragraph 561.07(7)(b) of the French version of the Regulations is replaced by the following:

26. The portion of subsection 601.01(4) of the Regulations before paragraph (a) is replaced by the following:
(4) The geographical location and the horizontal and vertical limits of the following items are those specified in the Designated Airspace Handbook:
27. Subparagraph 602.60(1)(e)(i) of the French version of the Regulations is replaced by the following:

28. The portion of subsection 602.131(1) of the French version of the Regulations before paragraph (a) is replaced by the following:

29. Paragraph 605.41(1)(b) of the French version of the Regulations is replaced by the following:

31. The heading of Division XI of Subpart 5 of Part VII of the English version of the Regulations is replaced by the following:
Division XI — Interference With a Crew Member
32. The definition “interference with a crew member” in section 705.171 of the Regulations is replaced by the following:
“interference with a crew member” means any action or statement set out in the levels listed in section 705.175 by a person on board or about to board an aircraft that distracts a crew member from their assigned safety responsibilities or prevents the crew member from carrying out those responsibilities; (“entrave au travail d’un membre d’équipage”)
33. (1) Subsection 705.172(2) of the French version of the Regulations is replaced by the following:
(2) L’exploitant aérien doit préciser dans le manuel d’exploitation de la compagnie et son manuel de l’agent de bord les procédures établies conformément au paragraphe (1).
34. (1) The portion of section 705.173 of the Regulations before paragraph (a) is replaced by the following:
705.173 An air operator shall provide initial and annual training to all operational personnel that covers the topics set out in subsection 725.124(56) of Standard 725 — Airline Operations — Aeroplanes of the Commercial Air Service Standards for the purpose of enabling
(2) Paragraph 705.173(a) of the French version of the Regulations is replaced by the following:

35. Subsection 705.174(2) of the French version of the Regulations is replaced by the following:

36. (1) The portion of paragraph 705.175(a) of the Regulations before subparagraph (i) is replaced by the following:
- (a) a level 1 incident, which is an incident of a minor nature that either requires no action of the crew member beyond heightened awareness or is quickly resolved by a crew member, and which includes but is not limited to
(2) Subparagraph 705.175(b)(ii) of the Regulations is replaced by the following:
- (ii) the continuation of a level 1 incident that was unresolved,
(3) The portion of paragraph 705.175(c) of the English version of the Regulations before subparagraph (i) is replaced by the following:
- (c) a level 3 incident, which is an incident where the safety of passengers or crew members is seriously threatened and which includes but is not limited to
COMING INTO FORCE
37. These Regulations come into force 60 days after the day on which they are published in the Canada Gazette, Part II.
