BROADCASTING ACT

Regulations Amending the Broadcasting Distribution Regulations

Whereas, pursuant to subsection 10(3) of the Broadcasting Act (see footnote a), a copy of the proposed Regulations Amending the Broadcasting Distribution Regulations, substantially in the annexed form, was published in the Canada Gazette, Part I, on September 21, 2013, and a reasonable opportunity was given to licensees and other interested persons to make representations to the Canadian Radio-television and Telecommunications Commission with respect to the proposed Regulations;

Therefore, the Canadian Radio-television and Telecommunications Commission, pursuant to subsection 10(1) of the Broadcasting Act (see footnote b), makes the annexed Regulations Amending the Broadcasting Distribution Regulations.

REGULATIONS AMENDING THE BROADCASTING DISTRIBUTION REGULATIONS

AMENDMENT

1. Subsection 27(2) of the Broadcasting Distribution Regulations (see footnote 1) is replaced by the following:

(2) Except as otherwise provided under a condition of its licence, a licensee shall, for every one to three non-Canadian third-language services that it distributes to its subscribers, distribute — to the extent that one or the other of the following is available — at least

2. These Regulations come into force on the day on which they are registered.

EXPLANATORY NOTE

(This note is not part of the Regulations.)

The proposed amendment will require a broadcasting distribution undertaking to distribute to subscribers either at least one ethnic Category A service or at least one Canadian third-language service for every one to three non-Canadian third-language services that the broadcasting distribution undertaking distributes to subscribers. This requirement will only apply if an ethnic Category A service or a Canadian third-language service is available in the same principal language as the one to three non-Canadian third-language services being distributed by the broadcasting distribution undertaking.
