Order Fixing February 6, 2014 as the Day on which Subsection 162(2) of the Act Comes into Force

His Excellency the Governor General in Council, on the recommendation of the Minister of Citizenship and Immigration, pursuant to section 169 of the Economic Action Plan 2013 Act, No. 1, chapter 33 of the Statutes of Canada, 2013, fixes February 6, 2014 as the day on which subsection 162(2) of that Act comes into force.
EXPLANATORY NOTE

Proposal
Pursuant to section 169 of the Economic Action Plan 2013 Act, No. 1 (the Act), which was assented to on June 26, 2013, this Order in Council (OIC) brings into force subsection 162(2) of that Act on February 6, 2014. This provision amends the Immigration and Refugee Protection Act.
Objective
This Order brings into force a section of the Act which exempts from the application of the User Fees Act certain fees for services provided in the administration of the Immigration and Refugee Protection Act.
Bringing this section of the Act into force will allow the Government to make and to adopt in a timely and efficient manner regulations to set and collect certain immigration service fees in line with modern cost recovery, program and operational governmental philosophies.
Background
Subsection 162(2) of the Act amends the Immigration and Refugee Protection Act to exempt from the application of the User Fees Act fees for the provision of services in relation to the processing of an application for a temporary resident visa, work permit, study permit or extension of an authorization to remain in Canada as a temporary resident.
Implications
This OIC will bring into force a legislative provision exempting certain fees for temporary resident immigration services from the application of the User Fees Act.
Consultation
The ability for fees to be set in a timely and efficient manner for the temporary resident immigration services in question was introduced through Budget 2013. There has been minimal reaction in the media.
