ENVIRONMENTAL ENFORCEMENT ACT
Order Fixing June 22, 2012 as the Day on which Certain Sections of the Act Come into Force

His Excellency the Governor General in Council, on the recommendation of the Minister of the Environment, pursuant to section 128 of the Environmental Enforcement Act, chapter 14 of the Statutes of Canada, 2009, hereby fixes June 22, 2012 as the day on which sections 72 to 80, 87 and 88 of that Act come into force.
EXPLANATORY NOTE

The Environmental Enforcement Act, chapter 14 of the Statutes of Canada, 2009, was assented to on June 18, 2009. The bulk of the Act was brought into force by Order in Council in December of 2010.
Sections 72 to 80, 87, and 88 have not yet been brought into force. These provisions amend certain offence, penalty and sentencing provisions of the Canadian Environmental Protection Act, 1999. They also allow the Governor in Council to create regulations implementing the updated penalty scheme under the Canadian Environmental Protection Act, 1999. Regulations creating the updated penalty scheme have been drafted as the Regulations Designating Regulatory Provisions for Purposes of Enforcement (Canadian Environmental Protection Act, 1999) and will be presented for registration after this Order in Council has been registered.
These sections must come into force prior to the proposed Regulations Designating Regulatory Provisions for Purposes of Enforcement (Canadian Environmental Protection Act, 1999). It is therefore recommended that the Order in Council, bringing into force sections 72 to 80, 87 and 88 of the Environmental Enforcement Act be registered prior to the aforementioned Regulations.
