PAYMENT CLEARING AND SETTLEMENT ACT
Notice of designation to Interac Corp.
Under subsection 4(1) of the Payment Clearing and Settlement Act (the “Act”), where the Governor of the Bank of Canada is of the opinion that a clearing and settlement system could be operated in a manner that poses a payments system risk, the Governor may, if the Minister of Finance is of the opinion that it is in the public interest to do so, designate the clearing and settlement system as a system that is subject to Part I of the Act.
Interac Corp. operates the Inter Member Network (IMN), which millions of Canadians rely on for their payment needs. The IMN is eligible to be designated under the Act since it has at least three participants (at least one of which is a Canadian participant and at least one of which has its head office in a jurisdiction other than the head office jurisdiction of Interac Corp.), clearing and settlement are conducted in Canadian dollars, and payment obligations that arise from clearing within the system are ultimately settled through adjustments to the accounts of participants at the Bank of Canada.
Given the significant value and volume of daily transactions, critical interdependencies, and centrality of the IMN to the Canadian retail payments landscape, a material disruption or failure raises the concern of a payments system risk, as it may cause significant adverse effect on economic activity by impairing the ability to make payments or by producing a general loss of confidence in the overall payments system.
I am of the opinion that the IMN could be operated in such a manner as to pose a payments system risk and therefore should be designated as subject to Part I of the Act. The Minister of Finance is of the opinion that it would be in the public interest to designate the IMN.
Accordingly, the IMN is hereby designated pursuant to subsection 4(1) of the Act, effective October 16, 2023.

Notice of designation to Mastercard International Inc.

The Mastercard system is eligible to be designated under the Act since it has at least three participants (at least one of which is a Canadian participant and at least one of which has its head office in a jurisdiction other than the head office jurisdiction of Mastercard International Inc.), clearing and settlement for most Canadian originated transactions are conducted in Canadian dollars, and payment obligations that arise from clearing within the system are ultimately settled through adjustments to the accounts of participants at the Bank of Canada.

CANADA MARINE ACT
Hamilton-Oshawa Port Authority — Supplementary letters patent
WHEREAS the Governor in Council issued a Certificate of Amalgamation containing letters patent to amalgamate the Hamilton Port Authority and the Oshawa Port Authority and to continue as one port authority named the Hamilton-Oshawa Port Authority (“Authority”), effective January 18, 2019;
WHEREAS Schedule B of the letters patent describes the federal real property or federal immovables managed by the Authority;
WHEREAS the Minister of Transport (“Minister”) may transfer the management of federal real property or federal immovables under his administration to the Author-ity under subsection 44(2) of the Canada Marine Act (“Act”);
WHEREAS the Minister wishes to transfer management of federal real property described below, located in Port Colborne and Thorold, and administered by the Minister, to the Authority;
WHEREAS, pursuant to subsection 9(1) of the Act, the Minister wishes to issue, on his own initiative, supplementary letters patent to amend Schedule B of the Authority’s letters patent;
WHEREAS, pursuant to subsection 9(2) of the Act, notice of the proposed changes to the letters patent was given in writing to the board of directors of the Authority;
AND WHEREAS the Minister is satisfied that the amendment to the letters patent is consistent with the Act;
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent are amended as follows:
- Schedule B of the letters patent of the Author-ity is amended by adding the following after Part 2 (Oshawa):
