QUARANTINE ACT

Order Amending the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Quarantine, Isolation and Other Obligations)

Whereas the Administrator in Council is of the opinion, based on the declaration of a pandemic by the World Health Organization, that there is an outbreak of a communicable disease, namely coronavirus disease 2019 (COVID-19), in the majority of foreign countries;

Whereas the Administrator in Council is of the opinion that the introduction or spread of COVID-19 would pose an imminent and severe risk to public health in Canada;

Whereas the Administrator in Council is of the opinion that the entry of persons into Canada who have recently been in a foreign country may introduce or contribute to the spread in Canada of COVID-19 or of new variants of the virus causing COVID-19 that pose risks that differ from those posed by other variants but that are equivalent or more serious;

And whereas the Administrator in Council is of the opinion that no reasonable alternatives to prevent the introduction or spread of COVID-19 are available;

Therefore, His Excellency the Administrator of the Government of Canada in Council, on the recommendation of the Minister of Health, pursuant to section 58 of the Quarantine Act footnote a, makes the annexed Order Amending the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Quarantine, Isolation and Other Obligations).

Amendment

1 Subsection 7.12(2) of the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Quarantine, Isolation and Other Obligations) footnote 1 is replaced by the following:

July 5, 2021

(2) Sections 7.1 to 7.9 come into force at 00:01:00 a.m. Eastern Daylight Time on July 5, 2021.

Coming into Force

2 This Order comes into force on the day on which it is made.

Proposal

This Order in Council, entitled Order Amending the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Quarantine, Isolation and Other Obligations), is made pursuant to section 58 of the Quarantine Act.

The Order is supplemental to Order in Council P.C. 2021-615, Minimizing the Risk of Exposure to COVID-19 in Canada Order (Quarantine, Isolation and Other Obligations), which came into force on June 21, 2021.

This Order will be in effect from the date it is made.

Objective

This Order amends P.C. 2021-615, subsection 7.12(2), to change the coming-into-force date for provisions relating to fully vaccinated travellers from 11:59:59 p.m. Eastern daylight time, on July 5, 2021, to 12:01 a.m. Eastern daylight time, on July 5, 2021.

Background

P.C. 2021-615, the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Quarantine, Isolation and Other Obligations), came into force on June 21, 2021, and expires on July 21, 2021. The objective of P.C. 2021-615 is to reduce the introduction and further spread of COVID-19 and new variants of the virus in Canada by decreasing the risk of importing cases from outside the country.

Key impacts for persons entering Canada

This Order makes a technical amendment to provide clarity with respect to communications about the P.C. 2021-615 provisions for fully vaccinated travellers, which were announced as coming into force on July 5, 2021. The substantive changes for fully vaccinated travellers were originally set to come into force at 11:59:59 p.m. Eastern daylight time, on July 5, 2021. This Order now sets the coming into force of these changes at 12:01 a.m. Eastern daylight time, on July 5, 2021.

The Government of Canada has engaged provinces and territories to coordinate efforts and implementation plans. In addition, there has been consultation across multiple government departments, including the Canada Border Services Agency; Immigration, Refugees and Citizenship Canada; Transport Canada; Public Safety Canada; and Global Affairs Canada, given linkages to departmental mandates and other statutory instruments.
