SPECIAL IMPORT MEASURES ACT
Certain grinding media — Decisions
On April 30, 2021, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made preliminary determinations of dumping and subsidizing concerning certain grinding media originating in or exported from India.
The subject goods are usually imported under the following tariff classification numbers:
- 7325.91.00.10
- 7325.91.00.90
The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Canadian industry and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determinations of dumping and subsidizing.
Pursuant to section 8 of SIMA, provisional duty is payable on subject goods that are released from the CBSA during the period commencing April 30, 2021, and ending on the earlier of the day the investigation is terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.
The amount of provisional duties payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duties. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.
Information
The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA website.

APPLICATION TO EXPORT ELECTRICITY TO THE POWER AUTHORITY OF THE STATE OF NEW YORK AS A BORDER ACCOMMODATION
Ontario Power Generation Inc.
By an application dated 26 April 2021, Ontario Power Generation Inc. (the Applicant) has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulatory Act for authorization to export up to 500 kW of firm power and up to 200 MWh per year of firm energy for a period of 10 years commencing on 1 July 2021 as a border accommodation. This export would be in accordance with the terms of the Memorandum of Understanding between the Power Authority of the State of New York and Ontario Hydro dated 17 October 1961 and the amended Memorandum of Understanding between the Power Authority of the State of New York and Ontario Hydro dated 2 October 1998.
The Commission of the CER (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.
- The Applicant shall provide a copy of the application by email, to any person who requests one by emailing opgregaffairs@opg.com. A copy of the application is also publicly available on the CER's website. You can access the CER's regulatory electronic document repository, enter the company name and click on “Search.”
- Written submissions that any interested party wishes to present shall be filed online with the CER in care of the Secretary of the Commission, and emailed to the Applicant, Ontario Power Generation Inc., at opgregaffairs@opg.com by 7 June 2021.
- Any answer to submissions that the Applicant wishes to present in response to item 2 of this Notice of Application and Directions on Procedure shall be filed with the CER in care of the Secretary of the Commission and emailed to the party that filed the submission by 22 June 2021.

COMMENCEMENT OF INQUIRY (E-REGISTRY SERVICE PILOT PROJECT)
Certain grinding media
Notice was received by the Canadian International Trade Tribunal on April 30, 2021, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations (Inquiry No. NQ-2021-001) had been made respecting the dumping and subsidizing of chrome cast iron grinding media in spherical (“ball”) or ovoid shape, with a diameter of 12.7 millimetres (½ inch) to and including 76.2 millimetres (3 inches) within tolerances of 5 percent (5%), with an alloy composition of 10 percent or more (≥ 10% of total mass) chromium (“Cr”) content and produced through the casting method, originating in or exported from the Republic of India.
Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.
Each person or government wishing to participate in the inquiry and at the hearing as a party must file a Form I — Notice of Participation, with the Tribunal on or before May 17, 2021. Each counsel who intends to represent a party in the inquiry and at the hearing must file a Form II — Notice of Representation, as well as a Form III — Declaration and Undertaking, with the Tribunal on or before May 17, 2021. The forms can be found in English and French on the Tribunal's website.
The Tribunal will hold a public hearing relating to this inquiry in July 2021. Given the current COVID-19 situation, the type of hearing, the place, and the exact date will be communicated at a later date.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2020-065) on April 23, 2021, with respect to a complaint filed by Joe Parsons Construction Ltd. of Reserve Mines, Nova Scotia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. EP899-210725/B) by the Department of Public Works and Government Services. The solicitation was for the provision of labour, equipment and materials to perform miscellaneous minor earthworks and hydraulic seeding.
Joe Parsons Construction Ltd. alleged that it was prejudiced in the procurement process, as the terms of the re-tendered solicitation were the same as the original solicitation and its bid price was previously published. Joe Parsons Construction Ltd. also alleged a breach of contract.
Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was valid.
