Heavy plate — Decisions
On January 7, 2021, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA), terminated the investigation in respect of certain heavy plate exported from Turkey by Ereğli Demir ve Çelik Fabrikaları T.A.Ş., as there was no margin of dumping.
On the same day, pursuant to paragraph 41(1)(b) of SIMA, the CBSA made a final determination of dumping concerning certain heavy plate originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) and Germany.
The subject goods are usually classified under the following tariff classification numbers:
- 7208.51.00.10
- 7208.51.00.93
- 7208.51.00.94
- 7208.51.00.95
- 7208.52.00.10
- 7208.52.00.93
- 7208.52.00.96
The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the Canadian industry is continuing, and it will issue its decision by February 5, 2021. Provisional duty will continue to be imposed on the subject goods from the Chinese Taipei and Germany until the CITT renders its decision. However, provisional anti-dumping duty will no longer be imposed on imports of goods of the same description as the goods in respect of which the dumping investigation has been terminated. Any provisional duty paid or security posted will be refunded, as appropriate.
If the CITT finds that the dumping has caused injury or is threatening to cause injury, anti-dumping duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duty.
The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.
Information
The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA’s website.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (file No. PR-2020-051) on January 4, 2021, with respect to a complaint filed by Ten Barrel Inc. d.b.a. Nomad Air (Nomad Air), of Whitehorse, Yukon, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W3048-21-KJ25) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for aircraft rental for parachutists.
Nomad Air alleged that PWGSC had awarded the contract to a supplier that did not comply with the terms of the request for proposals.
Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2020-034) on January 11, 2021, with respect to a complaint filed by Falcon Environmental Inc. (Falcon), of Saint-Lazare, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W0125-20WR08/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of wildlife control services on and around the aircraft landing runways for Canadian Forces Base Trenton, Ontario, and Canadian Forces Detachment Mountain View, Ontario.
Falcon alleged that the evaluation of bids in the solicitation was not conducted in accordance with the stated evaluation criteria.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-070) from 1091847 Ontario Ltd., of Ottawa, Ontario, concerning a procurement (Solicitation No. BPM011111) by Shared Services Canada (SSC). The solicitation was for the supply and delivery of Extreme Networks local area network (LAN) switches, or equivalent products, and the provision of associated maintenance and support services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on December 31, 2020, to conduct an inquiry into the complaint.
1091847 Ontario Ltd. alleges that SSC improperly conducted the above-noted procurement by scheduling events in the tendering process in order to prevent certain suppliers from submitting tenders and refusing to provide information to allow suppliers of equivalent products to submit bids.

Notice is hereby given that, on December 30, 2020, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act (SIMA), the Tribunal continued its finding (Expiry Review No. RR-2019-006) made on April 2, 2015, in Inquiry No. NQ-2014-002, concerning the dumping of oil country tubular goods, which are casing, tubing and green tubes made of carbon or alloy steel, welded or seamless, heat-treated or not heat-treated, regardless of end finish, having an outside diameter from 2 3/8 inches to 13 3/8 inches (60.3 mm to 339.7 mm), meeting or supplied to meet American Petroleum Institute (API) specification 5CT or equivalent and/or enhanced proprietary standards, in all grades, excluding drill pipe, pup joints, couplings, coupling stock and stainless steel casing, tubing or green tubes containing 10.5 percent or more by weight of chromium, originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu, the Republic of India, the Republic of Indonesia, the Republic of Korea, the Kingdom of Thailand, the Republic of Turkey, Ukraine and the Socialist Republic of Vietnam.
Pursuant to paragraph 76.03(12)(a) of SIMA, and following the determination of the President of the Canada Border Services Agency that the expiry of the finding is unlikely to result in the continuation or resumption of dumping of the aforementioned goods originating in or exported from the Republic of the Philippines, the Tribunal rescinded its finding with respect to those goods.
