Certain corrosion-resistant steel sheet — Decisions
On October 16, 2020, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) terminated the dumping investigation with respect to certain corrosion-resistant steel sheet originating in or exported from Turkey by Borçelik Sanayi Ticaret A.Ş (Borçelik), and originating in or exported from the United Arab Emirates by Al Ghurair Iron & Steel.
The CBSA also terminated the subsidy investigation with respect to certain corrosion-resistant steel sheet originating in or exported from Turkey by Atakaş Çelik Sanayi ve Ticaret A.Ş (Atakaş), Borçelik and Tatmetal Çelik Sanayi Ve Ticaret A.Ş. (Tatmetal), and originating in or exported from the United Arab Emirates and Vietnam by all exporters, as there was no subsidizing or the amounts of subsidy were insignificant.
On the same day, pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of dumping concerning certain corrosion-resistant steel sheet originating in or exported from Turkey, the United Arab Emirates and Vietnam, and a final determination of subsidizing with respect to certain corrosion-resistant steel sheet originating in or exported from Turkey.

The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the Canadian industry is continuing, and it will issue its decisions by November 13, 2020. Provisional duties will continue to be imposed on the subject goods until the CITT renders its order or finding. However, provisional anti-dumping duties on imports of goods exported from Turkey by Borçelik and exported from the United Arab Emirates by AGIS, and provisional countervailing duties on imports of goods exported from Turkey by Atakaş, Borçelik and Tatmetal, and the United Arab Emirates and Vietnam by all exporters will no longer be collected, and provisional anti-dumping and countervailing duties paid or security posted on these goods during the provisional period will be returned.
If the CITT finds that the dumping and/or subsidizing has caused injury or is threatening to cause injury, anti-dumping duties and/or countervailing duties will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.
The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duties.
Information
The legislated deadlines for the final decisions respecting certain corrosion-resistant steel sheet from Turkey, the United Arab Emirates and Vietnam were extended by three months in order to alleviate pressures brought on by the COVID-19 pandemic to interested parties, under the authority of Bill C-20 and the Order Respecting Time Limits Under the Special Import Measures Act (COVID-19) that was signed on September 30, 2020.

Heavy plate — Decisions
On October 9, 2020, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a preliminary determination of dumping concerning certain hot-rolled carbon steel heavy plate and high-strength low-alloy steel heavy plate from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), Germany and Turkey.
On the same date, the President of the CBSA, pursuant to paragraph 35(2)(a) of SIMA, terminated the dumping investigation in respect of the above-mentioned goods originating in or exported from South Korea and Malaysia.
The subject goods are normally classified under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the domestic industry and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determination of dumping.
Pursuant to section 8 of SIMA, provisional duties are payable on subject goods that are released from the CBSA during the period commencing October 9, 2020, and ending on the earlier of the day the investigation is terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.
The amount of provisional duties payable is not greater than the estimated margin of dumping. The Customs Act applies with respect to the accounting and payment of provisional duties. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

NOTICE OF PUBLIC COMMENT PERIOD FOR AN APPLICATION FOR A PERMIT TO BUILD AND OPERATE AN INTERNATIONAL POWER LINE
Application by Hydro-Québec TransÉnergie for a permit to build and operate a direct current power line linking Appalaches substation to the New England Clean Energy Connect project in the United States
On 30 September 2019, under section 248 of the Canadian Energy Regulator Act, Hydro-Québec TransÉnergie (the Applicant) filed an application with the Commission of the Canada Energy Regulator (Commission) for a permit to build and operate a 320-kV direct current international power line. The selected line route cited in this application covers a distance of approximately 103 km, from Appalaches substation in the municipality of Saint-Adrien-d’Irlande to a point located in the municipality of Frontenac, at the border between Québec and the state of Maine (United States).
The Commission wishes to obtain the views of interested parties on this Application before issuing a permit or making a recommendation to the Minister of Natural Resources requesting a designation order by the Governor in Council for certification procedures. The directions below explain in detail the procedure that will be used.
- 1. The Applicant shall provide a copy of the Application via email to any person who requests one by contacting Ms. Julie Couture, Advisor - Government approvals by email at couture.julie@hydroquebec.com. The Application is also publicly available on the CER’s website at https://apps.cer-rec.gc.ca/REGDOCS/Item/View/3828338.
- 2. Submissions that any party wishes to make shall be filed online with the Canada Energy Regulatory (CER), and emailed to the Applicant, by 3 December 2020.
- 3. The Commission is interested in the views of interested parties with respect to the impacts and effects of the Project, including any potential mitigation measures.
- 4. Any reply to submissions that the Applicant wishes to submit shall be filed with the CER and emailed to the party that filed the submission by 17 December 2020.
- 5. A schedule for the remaining procedural stages is provided in Appendix B of the Procedural Directive No. 2, publicly available on the CER’s website (https://apps.rec-cer.gc.ca/REGDOCS/Fichier/T%C3%A9l%C3%A9chargement/3972901). Specific dates will be added to this schedule after the comment period has ended.
To the extent possible, the Commission wishes to minimize duplications with the provincial regulatory process, namely, the environmental assessment process conducted by the Ministère de l’Environnement et de la Lutte contre les changements climatiques [Québec department of the environment and the fight against climate change], including all public hearings and consultation sessions held by the Bureau d’audiences publiques sur l’environnement [Québec office for public hearings on the environment]. In light of this, any issues that were raised and resolved in the above noted processes should not be resubmitted to the CER.

COMMENCEMENT OF INQUIRY (E-REGISTRY SERVICE PILOT PROJECT)

Notice was received by the Canadian International Trade Tribunal on October 9, 2020, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that a preliminary determination had been made respecting the dumping of certain hot-rolled carbon steel plate and highstrength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths greater than 72 inches (+/− 1,829 mm) to 152 inches (+/− 3,860 mm) inclusive, and thicknesses from 0.375 inches (+/− 9.525 mm) up to and including 4.5 inches (+/− 114.3 mm) [with all dimensions being plus or minus allowable tolerances contained in the applicable standards], originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen, and Matsu (Chinese Taipei), the Federal Republic of Germany and the Republic of Turkey (the subject goods), but excluding
- plate in coil form,
- plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), and
- plate originating in or exported from the Republic of Korea which is covered by the Tribunal’s finding in Inquiry No. NQ-2013-005.
For greater certainty, the subject goods include steel plate which contains alloys greater than required by recognized industry standards, provided the steel does not meet recognized industry standards for an alloy grade steel plate.
Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2020-001) to determine whether the dumping of the above-mentioned goods has caused injury or retardation or is threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.
Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Tribunal on or before October 26, 2020. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before October 26, 2020.
The Tribunal will hold a hearing relating to this inquiry in early January 2021. Given the current COVID-19 situation, the type of hearing, the place and the exact date will be communicated at a later date.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential edited version or non-confidential summary of the information designated as confidential, or a statement indicating why such a version or summary cannot be made.

Notice is hereby given that, on October 13, 2020, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined that there was evidence in the preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2020-003) that disclosed a reasonable indication that the dumping of certain wheat gluten has caused or is threatening to cause injury to the domestic industry.

Parachute operations
The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-051) from Ten Barrel Inc. d.b.a. Nomad Air (Nomad Air), of Whitehorse, Yukon, concerning a procurement (Solicitation No. W3048-21-KJ25) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for aircraft rental for parachutists. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on October 13, 2020, to conduct an inquiry into the complaint.
Nomad Air alleges that PWGSC awarded the contract to a supplier that did not comply with the terms of the request for proposals.

Notice is hereby given that, on October 14, 2020, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, the Canadian International Trade Tribunal continued its finding (Expiry Review No. RR-2019-00) in respect of the dumping of hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly identified as rebar, in various diameters up to and including 56.4 mm, in various finishes, excluding plain round bar and fabricated rebar products, originating in or exported from the People’s Republic of China, the Republic of Korea and the Republic of Turkey and the subsidizing of the aforementioned goods originating in or exported from the People’s Republic of China. In accordance with the Tribunal’s finding in Inquiry No. NQ-2014-001, the product definition also excludes 10-mm-diameter (10M) rebar produced to meet the requirements of CSA G30 18.09 (or equivalent standards) and coated to meet the requirements of epoxy standard ASTM A775/A 775M 04a (or equivalent standards) in lengths from 1 foot (30.48 cm) up to and including 8 feet (243.84 cm).
