Certain decorative and other non-structural plywood — Decisions
On June 11, 2020, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain decorative and other non-structural plywood from China.

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

Representations
Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. During the COVID-19 pandemic written submissions must be sent electronically to simaregistry@cbsa-asfc.gc.ca. To be given consideration in these investigations, this information should be received by October 19, 2020.
Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

Call for Bids No. NL20-CFB01 (Eastern Newfoundland)
The Canada–Newfoundland and Labrador Offshore Petroleum Board hereby gives notice of a call for the submission of bids in respect of 17 parcels in the Canada–Newfoundland and Labrador Offshore Area.
This notice of Call for Bids No. NL20-CFB01 is made pursuant and subject to the Canada–Newfoundland and Labrador Atlantic Accord Implementation Act, S.C. 1987, c. 3, and the Canada-Newfoundland and Labrador Atlantic Accord Implementation Newfoundland and Labrador Act, R.S.N.L. 1990, c. C-2.
The following is a summary of Call for Bids No. NL20-CFB01:
- (i) The Board informs prospective bidders for these parcels, which are partially or entirely beyond Canada’s 200-nautical-mile zone, that it has been advised by the Government of Canada that, in order to meet obligations arising pursuant to article 82 of the United Nations Convention on the Law of the Sea, additional terms and conditions may be applied through legislation, regulations, amendments to licences or otherwise.
- (ii) Each Bid Package must be received by the Board in a sealed envelope prior to the time of closing of Call for Bids No. NL20-CFB01. This Call for Bids will close at 12:00 p.m., Newfoundland Standard Time, on November 4, 2020, except as specifically provided for in Call for Bids No. NL20-CFB01.
- (iii) Each Bid Package must be prepared and submitted in accordance with the terms and conditions of Call for Bids No. NL20-CFB01.
- (iv) The parcels are located offshore Newfoundland and Labrador and are described in Schedule I. An Exploration Licence may be issued for each parcel.
- (v) For the purpose of selecting a bid, the sole criterion to be used will be the total amount of money the bidder commits to expend on exploration on the parcels within Period I (“Work Expenditure Bid”).
- (vi) The minimum Work Expenditure Bid will be $10 million for each parcel offered in this Call for Bids.
- (vii) Allowable expenditures may be claimed for those permitted expenses incurred from the date of the announcement of the Call for Nominations NL18-CFN01 up to and including the effective date of the licence. These new credits would be in addition to those allowable expenditures available for credit during the term of the licence.
- (viii) Period I of the Exploration Licence shall have a term of six years unless otherwise extended by a drilling deposit. Period II shall immediately follow Period I and consist of the balance of the original nine-year term.
- (ix) The Interest Owner may, at its option, extend Period I by up to three one-year extensions based upon the following escalating drilling deposits (each one a separate “Drilling Deposit”):
- Period I A — one-year extension — $5 million
- Period I B — one-year extension — $10 million
- Period I C — one-year extension — $15 million
- If a Drilling Deposit is posted, it will be refunded in full if the well commitment is met during the respective period of extension. Otherwise, the Drilling Deposit will be forfeited upon termination of that period extension.
- (x) The Work Expenditure Bid must be accompanied by a bank draft or certified cheque in the amount of $10,000 (“Bid Deposit”) made payable to the Receiver General. Furthermore, the successful bidder will be required to provide, within 15 days of notification of being the successful bidder, a promissory note in the amount of 25% of the Work Expenditure Bid (“Security Deposit”). A credit against the Security Deposit will be made on the basis of 25% of allowable expenditures as described in the Exploration Licence (“Allowable Expenditures”).
- (xi) A successful bidder will receive a refund, without interest, of the Bid Deposit when the Security Deposit is posted within 15 days of being notified they are the successful bidder. Failure to post the Security Deposit within 15 days will result in forfeiture of the Bid Deposit and disqualification of the bid.
- Following the announcement of the bid results, the Bid Deposits of unsuccessful bidders will be returned, without interest, as soon as possible.
- (xii) One well must be commenced within Period I and diligently pursued thereafter.
- (xiii) Rentals will be applicable only in Period II at the following rates:
- 1st year — $5.00 per hectare
- 2nd year — $10.00 per hectare
- 3rd year — $15.00 per hectare
- When an Exploration Licence continues in force beyond Period II, rentals will be payable at the rates applicable during the last year of Period II.
- Rentals will be refunded annually, to a maximum of 100% of the rentals paid in that year, on the basis of a dollar refund for each dollar of Allowable Expenditures for that year.
- Carry forward provisions to reduce rentals otherwise payable in ensuing rental years will apply.
- (xiv) Any resulting Significant Discovery Licence respecting the lands of any Exploration Licence resulting from the offer of a parcel in this Call for Bids No. NL20-CFB01 will be subject to the terms and conditions for Significant Discovery Licences existing at the time a Significant Discovery Licence is requested. A sample Significant Discovery Licence can be found as a Schedule to the Sample Exploration Licence
- (xv) A successful bidder will be required to comply with the procurement, employment and reporting procedures as established by the Board in its Canada-Newfoundland and Labrador Exploration Benefits Plan Guidance.
- (xvi) These parcels will be subject to the payment of issuance fees and Environmental Studies Research Fund levies.
- (xvii) The Board is not obliged to accept any bid or issue any interest as a result of this Call for Bids.
- (xviii) Any licence that may be issued shall be in the form of the Exploration Licence attached to Call for Bids No. NL20-CFB01.

Decorative and other non-structural plywood
The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2020-002) to determine whether the evidence discloses a reasonable indication that the dumping and subsidizing of decorative and other non-structural plywood, whether or not surface coated or covered, and veneer core platforms for the production of decorative and other non-structural plywood, originating in or exported from the People’s Republic of China (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA. Decorative and other non-structural plywood is defined as a flat, multilayered plywood or other veneered panel, consisting of two or more layers or plies of wood veneers and a core, with the face and/or back veneer made of wood. The veneers, along with the core are glued or otherwise bonded together. Decorative and other non-structural plywood include products that meet the American National Standard for Hardwood and Decorative Plywood, ANSI/HPVA HP-1-2016 (including any revisions to that standard), but exclude
- (a) Structural plywood that is manufactured to meet U.S. Products Standard PS 1-09, PS 2-09, or PS 2-10 for Structural Plywood (including any revisions to that standard or any substantially equivalent international standard intended for structural plywood), and which has both a face and a back veneer of coniferous wood;
- (b) Finished plywood products for use as flooring;
- (c) Plywood which has a shape or design other than a flat panel;
- (d) Phenolic film faced plyform (PFF), also known as phenolic surface film plywood (PSF), defined as a panel with an “Exterior” or “Exposure 1” bond classification as is defined by the Engineered Wood Association, having an opaque phenolic film layer with a weight equal to or greater than 90 g/m3 permanently bonded on both the face and back veneers and an opaque, moisture resistant coating applied to the edges; and
- (e) Laminated veneer lumber door and window components with (1) a maximum width of 44 millimetres, a thickness from 30 millimetres to 72 millimetres, and a length of less than 2 413 millimetres, (2) water boiling point exterior adhesive, (3) a modulus of elasticity of 1 500 000 pounds per square inch or higher, (4) finger-jointed or lap-jointed core veneer with all layers oriented so that the grain is running parallel or with no more than three dispersed layers of veneer oriented with the grain running perpendicular to the other layers, and (5) top layer machined with a curved edge and one or more profile channels throughout.
The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before June 24, 2020. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before June 24, 2020.
Submissions by parties opposed to the complaint must be filed not later than noon, on July 9, 2020. The complainants, as well as supporting parties, may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on July 16, 2020.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2019-053) on June 11, 2020, with respect to a complaint filed by SoftSim Technologies Inc. (SoftSim), of Montréal, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 20-166067) by the Department of Foreign Affairs, Trade and Development. The solicitation was for the provision of trade modernization task-based informatics professional services.
SoftSim alleged that its bid was improperly evaluated and that the terms of the solicitation favoured the successful bidder.
Having examined the evidence presented by the parties and considered the provisions of the Canadian Free Trade Agreement, the Tribunal determined that the complaint was not valid.

The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its order made on September 9, 2015, in Expiry Review No. RR-2014-004, concerning the dumping of certain whole potatoes, excluding seed potatoes, excluding imports during the period from May 1 to July 31, inclusive, of each calendar year, and excluding red potatoes, yellow potatoes and the exotic potato varieties, regardless of packaging, and white and russet potatoes imported in 50-lb. cartons in the following count sizes: 40, 50, 60, 70 and 80, and excluding whole potatoes certified as organic by a recognized certification agency, imported from the United States of America, for use or consumption in the province of British Columbia, is scheduled to expire (Expiry No. LE-2020-002) on September 8, 2020, unless the Tribunal has initiated an expiry review.

Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before June 25, 2020. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before June 25, 2020. The deadline for filing submissions requesting or opposing the initiation of an expiry review is July 6, 2020, by noon. If there are opposite views, each party may file a reply no later than July 14, 2020, by noon.
Submissions should include concise argument and supporting evidence concerning
- the likelihood of continued or resumed dumping of the goods;
- the likely volume and price ranges of dumped imports if dumping were to continue or resume;
- the domestic industry’s recent performance, including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
- the likelihood of injury to the domestic industry if the order were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped imports on the industry’s future performance;
- any other developments affecting, or likely to affect, the performance of the domestic industry;
- changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
- any other matter that is relevant.
