Heavy plate — Decision
On May 27, 2020, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated an investigation into the alleged injurious dumping of certain hot-rolled carbon steel heavy plate and high-strength low-alloy steel heavy plate from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), Germany, South Korea, Malaysia, and Turkey.
The subject goods are usually imported under the following tariff classification numbers:

- 7208.51.00.93
- 7208.51.00.94
- 7208.51.00.95
- 7208.52.00.10
- 7208.52.00.93
- 7208.52.00.96
The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

To be given consideration in this investigation, this information should be received by October 2, 2020.
Any information submitted by interested persons concerning this investigation will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES
Hydro-Québec
By an application dated June 6, 2020, Hydro-Québec (the “Applicant”) has applied to the Commission of the Canada Energy Regulator (the “Commission”), under Division 2 of Part 7 of the Canadian Energy Regulator Act (the “Act”), for authorization to export up to 30 000 000 MWh of combined firm and interruptible energy annually for a period of 10 years commencing on January 1, 2021. A description of the production and transmission facilities of the Applicant is included at page 115 in the Hydro-Québec Annual Report 2019.
The Commission wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The directions on procedure that follow explain in detail the procedure that will be used.
- 1. The Applicant shall provide a copy of the application by email to any person who requests one at cossette.helene@hydro.qc.ca. The application is also available on the Canada Energy Regulator website.
- 2. Submissions that any party wishes to present shall be filed online with the Secretary of the Commission and emailed to the Applicant by July 6, 2020.
- 3. Pursuant to subsection 359(2) of the Act, the Commission is interested in the views of submitters with respect to
- (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
- (b) whether the Applicant has
- (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
- (ii) given an opportunity to buy electricity on conditions as favourable as the conditions specified in the application to those who, within a reasonable time after being so informed, demonstrate an intention to buy electricity for consumption in Canada.
- 4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Commission and emailed to the party that filed the submission by July 21, 2020.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2020-001) to determine whether the evidence discloses a reasonable indication that the dumping of certain hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths greater than 72 inches (+/ 1,829 mm) to 152 inches (+/ 3,860 mm) inclusive, and thicknesses from 0.375 inches (+/ 9.525 mm) up to and including 4.5 inches (+/ 114.3 mm) [with all dimensions being plus or minus allowable tolerances contained in the applicable standards], originating in or exported from Chinese Taipei, the Federal Republic of Germany, the Republic of Korea, the Federation of Malaysia and the Republic of Turkey (the subject goods), but excluding
- plate in coil form,
- plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), and
- plate originating in or exported from the Republic of Korea which is covered by the Tribunal’s finding in Inquiry No. NQ-2013-005,
has caused injury or retardation or is threatening to cause injury, as these words are defined in SIMA. For greater certainty, the subject goods include steel plate which contains alloys greater than required by recognized industry standards, provided the steel does not meet recognized industry standards for an alloygrade steel plate.
The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before June 9, 2020. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before June 9, 2020.
Submissions by parties opposed to the complaint must be filed with the Tribunal not later than noon, on June 24, 2020. The complainant, as well as supporting parties, may make, and file with the Tribunal, submissions in response to the submissions of parties opposed to the complaint not later than noon, on July 2, 2020.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.
