Certain sucker rods — Decision
On December 30, 2019, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a preliminary determination of dumping concerning certain sucker rods from Argentina, Brazil, and Mexico.
The goods in question are usually classified under the following tariff classification number:
- 8413.91.00.10
The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Canadian industry and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determination of dumping.
Pursuant to section 8 of SIMA, provisional duties are payable on subject goods that are released from the CBSA during the period commencing December 30, 2019, and ending on the earlier of the day the investigation is terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.
The amount of provisional duties payable is not greater than the estimated margin of dumping. The Customs Act applies with respect to the accounting and payment of provisional duties. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

COMMENCEMENT OF INQUIRY
Sucker rods
Notice was received by the Canadian International Trade Tribunal on December 30, 2019, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that a preliminary determination had been made respecting the dumping of sucker rods, including pony rods, with or without couplings attached and with or without guides attached, manufactured to American Petroleum Institute (API) 11B specifications, equivalent standards or proprietary standards, including in a finished or semi-finished state, made of solid steel, including carbon, alloy and special grades of steel, of 2.5 in. (63.5 mm) or less in diameter of rod body, with stated measurements subject to permissible tolerances, originating in or exported from the Argentine Republic, the Federative Republic of Brazil and the United Mexican States.
Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2019-001) to determine whether the dumping of the above-mentioned goods has caused injury or retardation or is threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.
Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Tribunal on or before January 14, 2020. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before January 14, 2020.
A public hearing relating to this inquiry will be held in the Tribunal’s Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on March 30, 2020, at 9:30 a.m., to hear evidence and representations by interested parties.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Oil country tubular goods
The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act, that its finding made on April 2, 2015, in Inquiry No. NQ-2014-002, concerning the dumping of oil country tubular goods, which are casing, tubing and green tubes made of carbon or alloy steel, welded or seamless, heat-treated or not heat-treated, regardless of end finish, having an outside diameter from 2 3/8 in. to 13 3/8 in. (60.3 mm to 339.7 mm), meeting or supplied to meet American Petroleum Institute (API) specification 5CT or equivalent and/or enhanced proprietary standards, in all grades, excluding drill pipe, pup joints, couplings, coupling stock and stainless steel casing, tubing or green tubes containing 10.5% or more by weight of chromium, originating in or exported from Chinese Taipei, the Republic of India, the Republic of Indonesia, the Republic of the Philippines, the Republic of Korea, the Kingdom of Thailand, the Republic of Turkey, Ukraine and the Socialist Republic of Vietnam, is scheduled to expire (Expiry No. LE-2019-005) on April 1, 2020, unless the Tribunal has initiated an expiry review.
Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before January 20, 2020. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before January 20, 2020. The Tribunal will distribute the list of participants on January 21, 2020. The deadline for filing submissions is January 30, 2020. If there are opposing views, each party may file a response no later than February 7, 2020.
Submissions should include concise argument and supporting evidence concerning:
- the likelihood of continued or resumed dumping of the goods;
- the likely volume and price ranges of dumped imports if dumping was to continue or resume;
- the domestic industry’s recent performance, including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
- the likelihood of injury to the domestic industry if the finding were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped imports on the industry’s future performance;
- any other developments affecting, or likely to affect, the performance of the domestic industry;
- changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
- any other matter that is relevant.
Anyone who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary, or a statement indicating why such a summary cannot be made. Documents should be filed electronically through the Tribunal’s Secure E-filing Service. Only one electronic copy is required.
Counsel and parties are required to serve their submissions on each other on the same dates they file their submissions. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. Application for an order
Notice is hereby given that, on December 19, 2019, an application pursuant to section 92 of the Competition Act, R.S.C., 1985, c. C-34 (“Act”) was filed with the undersigned at the Competition Tribunal (“Tribunal”) by the Commissioner of Competition (“Commissioner”), regarding the acquisition by Parrish & Heimbecker, Limited (“P&H”) of certain grain elevators and related assets from Louis Dreyfus Company Canada ULC (“Application”).
The particulars of the orders sought by the Commissioner are as follows:
- an order requiring P&H to dispose of all of the assets of the ongoing business of a primary grain elevator in the relevant markets (as defined in the Application) [“Relevant Markets”], as well as such other assets, if any, as are required for an effective remedy;
- an order prohibiting P&H from acquiring, within a period of five years from the date of the order, any primary grain elevator in the Relevant Markets, unless P&H provides the Commissioner with at least 30 days’ advance written notice of such proposed merger, where the proposed merger would not otherwise be subject to notification pursuant to the Act;
- an order directing P&H to pay costs; and
- an order granting such further and other relief as the Commissioner may request and the Tribunal may consider appropriate.
Notice is hereby given that any motion for leave to intervene in this matter must be filed with the Tribunal on or before February 12, 2020.
