APPLICATION TO BUILD AND OPERATE AN INTERNATIONAL POWER LINE
Hydro-Québec TransÉnergie
By an application dated September 30, 2019, Hydro-Québec TransÉnergie (the “Applicant”) has applied to the Commission of the Canada Energy Regulator (the “Commission”), under section 248 of the Canadian Energy Regulator Act (the “Act”), for authorization to build and operate a 320-kV direct current international power line linking the Appalaches substation to the New England Clean Energy Connect project in the United States. The selected line route cited in this application covers a distance of approximately 103 km, from the Appalaches substation in the Municipality of Saint-Adrien-d’Irlande to a point located in the Municipality of Frontenac, at the border between Quebec and the State of Maine (United States).
The Commission wishes to inform all interested parties that it is now initiating a preliminary technical analysis of the application. Upon completion of said analysis, a second notice will be published, inviting all interested parties to submit their comments to the Commission before any decision is rendered concerning the permit application. To the extent possible, the Commission wishes to minimize duplications with the provincial regulatory process, namely, the environmental assessment process conducted by the Ministère de l’Environnement et de la Lutte contre les changements climatiques [Quebec department of the environment and the fight against climate change], including all public hearings consultation sessions held by the Bureau d’audiences publiques sur l’environnement (BAPE) [Quebec office for public hearings on the environment].
In the meantime, the Commission encourages all interested parties to submit any comments or concerns they may have to the Applicant and to participate in the review being carried out as part of the provincial regulatory process.

On April 1, 2011, the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure came into force. Public hearings on proposed nutrient concentration objectives and nutrient load targets for the Red River
The International Joint Commission (IJC) has announced that it is inviting public comment on recommendations made by the International Red River Board (IRRB) in a report describing proposed nutrient concentration objectives and nutrient load targets for the Red River at the boundary between the United States and Canada. Comments will be accepted at a public hearing to be held on January 16, 2020, in Fargo, North Dakota. Comments can also be sent by email (Commission@ottawa.ijc.org or Commission@washington.ijc.org) and online until February 28, 2020.

The Commission reports on water quality of the Red River as it crosses the boundary pursuant to a reference under Article IX of the Boundary Waters Treaty of 1909 (the Treaty) between the United States and Canada. Commission recommendations to the two federal governments under Article IX references of the Treaty are not binding and not to be considered decisions of the two federal governments.
The International Red River Board was established by the Commission in part to assist in reporting on the water quality of the Red River as it crosses the boundary and to recommend amendments or additions to the water quality objectives approved by the U.S. and Canadian governments in 1968 when considered warranted by the Commission.
In the 2000s, the IRRB identified nutrients as an issue of concern. The Board established a water quality committee to develop recommendations for potential nutrient load allocations and/or targets. At the IRRB’s September 2019 meeting, the Board agreed to recommend the following nutrient concentration objectives and nutrient load targets for the Red River at the boundary between the United States and Canada:

Commissioners will be present to hear comments at the above-referenced public hearing in Fargo, North Dakota, on January 16, 2020, from 7 to 9 p.m. A public comment period on the IRRB report will also be open through February 28, 2020. Public input is essential to the Commission’s consideration of a recommendation to the governments of the United States and Canada.
The International Joint Commission was established under the Boundary Waters Treaty of 1909 to help the United States and Canada prevent and resolve disputes over the use of the waters the two countries share. Its responsibilities include investigating and reporting on issues of concern when asked by the governments of the two countries. For more information, visit the Commission’s website.
