CANADIAN INTERNATIONAL TRADE TRIBUNAL
DETERMINATION
Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2019-010) on September 18, 2019, with respect to a complaint filed by the University of Saskatchewan (the University), of Saskatoon, Saskatchewan, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning the Living Laboratories Initiative: Collaborative Program led by the Department of Agriculture and Agri-Food (AAFC). The solicitation was for the co-development, assessment and implementation of innovative solutions to address persistent agri-environmental issues.
The University alleged that the University’s application was dismissed by AAFC on unsubstantiated grounds; that the process was not open and transparent and otherwise did not follow the evaluation and assessment deadlines, criteria and process set out by AAFC.
Having examined the evidence presented by the parties and considered the provisions of the applicable trade agreements, the Tribunal determined that the complaint was not valid.

DECISION
Softwood lumber products from Canada
Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the binational panel established to review the Final Injury Determination made by the United States International Trade Commission, respecting “Softwood Lumber Products from Canada,” issued its Interim Decision and Order on September 4, 2019 (Secretariat File No. USA-CDA-2018-1904-03).
In the September 4, 2019, Interim Decision and Order, the binational panel affirmed in part and remanded in part the investigating authority’s Final Injury Determination.
The binational panel instructed the investigating authority to provide its redetermination on remand within 90 days from the issuance of its Interim Decision and Order.
The public version of the Interim Decision and Order is available on the NAFTA Secretariat website under “Decisions and Reports” of the “Dispute Settlement” section.
EXPLANATORY NOTE
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994, and as amended, on March 29, 2008.
