Nitisinone capsules — Decision
On March 20, 2019, pursuant to paragraph 41(1)(b) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a final determination of dumping in respect of certain nitisinone capsules from Sweden.
The goods in question are usually classified under the following tariff classification numbers:
- 3003.90.00.90
- 3004.90.00.79
- 3004.90.00.90
The Canadian International Trade Tribunal’s (CITT) inquiry into the question of injury to the Canadian industry is continuing, and the CITT will issue its decision by April 18, 2019. Provisional duties will continue to be imposed on the subject goods until the CITT renders its finding.
If the CITT finds that the dumping has caused injury or is threatening to cause injury, antidumping duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.
The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of antidumping duty.

CANADIAN INTERNATIONAL TRADE TRIBUNAL
EXPIRY OF FINDING
Hot-rolled carbon steel plate
The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), that its finding made on May 20, 2014, in Inquiry No. NQ-2013-005, concerning the dumping of hot-rolled carbon steel plate and high-strength low-alloy steel plate, not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths from 24 inches (+/–610 mm) to 152 inches (+/–3,860 mm) inclusive, and thicknesses from 0.187 inches (+/ 4.75 mm) up to and including 3.0 inches (76.2 mm) [with all dimensions being plus or minus allowable tolerances contained in the applicable standards], but excluding plate for use in the manufacture of pipe and tube (also known as skelp); plate in coil form, plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), originating in or exported from the Federative Republic of Brazil, the Kingdom of Denmark, the Republic of Indonesia, the Italian Republic, Japan and the Republic of Korea, is scheduled to expire (Expiry No. LE-2018-009) on May 19, 2019, unless the Tribunal has initiated an expiry review.
Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before April 5, 2019. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before April 5, 2019. The Tribunal will distribute the list of participants on April 8, 2019. The deadline for filing submissions is April 16, 2019. If there are opposing views, each party may file a response no later than April 24, 2019.
Submissions should include concise argument and supporting evidence concerning
- the likelihood of continued or resumed dumping of the goods;
- the likely volume and price ranges of dumped imports if dumping was to continue or resume;
- the domestic industry’s recent performance, including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
- the likelihood of injury to the domestic industry if the finding were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped imports on the industry’s future performance;
- any other developments affecting, or likely to affect, the performance of the domestic industry;
- changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
- any other matter that is relevant.
Anyone who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary, or a statement indicating why such a summary cannot be made. Documents should be filed electronically through the Tribunal’s Secure E-filing Service. Only one electronic copy is required.
Counsel and parties are required to serve their submissions on each other on the same dates they file their submissions. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsels who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. Submissions that contain information that is confidential to your company/government or your client may be served by electronic means provided you are willing to accept the associated risks. The Tribunal will decide by May 9, 2019, on whether an expiry review is warranted. If not warranted, the finding will expire on its scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.

NOTICE TO INTERESTED PARTIES
The Commission posts on its website the decisions, notices of consultation and regulatory policies that it publishes, as well as information bulletins and orders. On April 1, 2011, the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure came into force. NATIONAL ENERGY BOARD
APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES
Nova Scotia Power Incorporated
By an application dated March 20, 2019, Nova Scotia Power Incorporated (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export up to 1 200 000 MWh of combined firm and interruptible energy annually for a period of 10 years. Information concerning the Applicant’s and its affiliates’ interests in generation and transmission facilities and energy supply arrangements are provided in the Applicant’s application package, which is available on the Board’s online regulatory database.
The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The directions on procedure that follow explain in detail the procedure that will be used.
- The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Nova Scotia Power Incorporated, 1223 Lower Water Street, Halifax, Nova Scotia B3J 3S8, 902‑428‑6109 (telephone), 902‑428‑4006 (fax), and provide a copy of the application to any person who requests one. - Pursuant to subsection 119.06(2) of the Act, the Board is interested in the views of submitters with respect to
- (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
- (b) whether the Applicant has
- (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
- (ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.
- Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by May 23, 2019.
