DETERMINATION

Architect and engineering services

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2018-036) on February 26, 2019, with respect to a complaint filed by Temprano and Young Architects Inc. (Temprano and Young) of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. LW082) by the National Capital Commission (NCC). The solicitation was for the services of architectural consulting firms on an “as and when requested” basis.

Temprano and Young alleged that the NCC failed to evaluate its bid in accordance with the evaluation process and essential criteria set out in the tender documents, and did not exercise due diligence to ensure a fair and unbiased evaluation. Temprano and Young further alleged that the structure of the essential requirements of the tender was flawed and could not result in a fair and impartial evaluation.

Having examined the evidence presented by the parties and considered the provisions of the Canadian Free Trade Agreement, the Tribunal determined that the complaint was not valid.

SPECIES AT RISK ACT

Description of critical habitat of Wild Hyacinth in Point Pelee National Park of Canada

The Wild Hyacinth (Camassia scilloides) is a spring-flowering plant with pale blue to white star-shaped flowers listed on Schedule 1 of the Species at Risk Act. In Canada, the Wild Hyacinth can be found in open deciduous woodlands and hawthorn scrub, and is restricted to the Lake Erie Islands of Ontario.

The Recovery Strategy for the Wild Hyacinth (Camassia scilloides) in Canada identifies critical habitat for the species within Point Pelee National Park of Canada.

Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Wild Hyacinth, identified in the recovery strategy for that species that is included in the Species at Risk Public Registry, and that is located within Point Pelee National Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.
