CANADIAN INTERNATIONAL TRADE TRIBUNAL

INQUIRY

Communications, detection and fibre optics

The Canadian International Trade Tribunal has received a complaint (File No. PR-2018-049) from Accipiter Technologies Inc. (Accipiter), of Fonthill, Ontario, concerning a procurement (Solicitation No. F7048-160039/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans (DFO). The solicitation is for the provision of radar equipment replacement for the DFO. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on December 20, 2018, to conduct an inquiry into the complaint.

Accipiter alleges that PWGSC unfairly conducted the procurement process, erred in the evaluation of Accipiter’s bid and improperly cancelled the solicitation.

PATENTED MEDICINE PRICES REVIEW BOARD

In the matter of the Patent Act, R.S.C. 1985, c. P-4, as amended

And in the matter of Horizon Pharma (the “Respondent”) and the medicine Cysteamine Bitartrate sold by the Respondent under the trade name “Procysbi”

Take notice that the Patented Medicine Prices Review Board (the “Board”) will hold a hearing in its offices in the Standard Life Centre, 333 Laurier Avenue West, 18th Floor, Ottawa, Ontario, on a date to be determined by the hearing panel no later than February 27, 2019.

The purpose of the hearing is to determine whether under sections 83 and 85 of the Patent Act the Respondent is selling or has sold the medicine Cysteamine Bitartrate sold by the Respondent under the trade name “Procysbi” in any market in Canada at a price that, in the Board’s opinion, is or was excessive and if so, what order, if any, should be made.

Procysbi is indicated for the treatment of the rare and lifelong multisystem genetic disorder nephropathic cystinosis. Among other symptoms, nephropathic cystinosis impairs the filtering function of the kidney, eventually progressing to kidney failure and necessitating a kidney transplant.

Persons wishing to intervene in the proceeding are required to apply to the Board for leave to intervene. Such persons should contact the Secretary of the Board for further information on the procedure.
