Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2018-015) on October 3, 2018, with respect to a complaint filed by SoftSim Technologies Inc. (SoftSim), of Montréal, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 18-22022) by the National Research Council Canada (NRC). The solicitation was for task-based informatics professional services.
SoftSim alleged that the NRC erred in its evaluation of certain point-rated criteria in SoftSim's technical bid.
Having examined the evidence presented by the parties and considered the provisions of the Canadian Free Trade Agreement, the North American Free Trade Agreement and the Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

EXPIRY OF FINDING
Circular copper tube
The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA) that its findings made on December 18, 2013, in Inquiry No. NQ-2013-004, concerning the dumping of circular copper tube with an outer diameter of 0.2 inch to 4.25 inches (0.502 centimetre to 10.795 centimetres) excluding industrial and coated or insulated copper tube, originating in or exported from the Federative Republic of Brazil, the Hellenic Republic, the People's Republic of China, the Republic of Korea and the United Mexican States, and the subsidizing of those goods originating in or exported from the People's Republic of China, are scheduled to expire (Expiry No. LE-2018-005) on December 17, 2018, unless the Tribunal has initiated an expiry review.
Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before October 17, 2018. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before October 17, 2018. The Tribunal will distribute the list of participants on October 18, 2018. The deadline for filing submissions is October 26, 2018. If there are opposing views, each party may file a response no later than November 6, 2018.
Submissions should include concise argument and supporting evidence concerning
- the likelihood of continued or resumed dumping and subsidizing of the goods;
- the likely volume and price ranges of dumped and subsidized imports if dumping and subsidizing were to continue or resume;
- the domestic industry's recent performance, including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
- the likelihood of injury to the domestic industry if the findings were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped and subsidized imports on the industry's future performance;
- any other developments affecting, or likely to affect, the performance of the domestic industry;
- changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
- any other matter that is relevant.
Anyone who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non- confidential edited version or summary, or a statement indicating why such a summary cannot be made. Documents should be filed electronically through the Tribunal's Secure E-filing Service. Only one electronic copy is required.
Counsel and parties are required to serve their submissions on each other on the same dates they file their submissions. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. Submissions that contain information that is confidential to your company/government or your client may be served by electronic means provided you are willing to accept the associated risks. Submissions that contain confidential information belonging to a company/government that is not your own or that is not represented by you must be served by courier. One electronic copy of proof of service must be served on the Tribunal.
The Tribunal will decide by November 20, 2018, on whether an expiry review is warranted. If not warranted, the findings will expire on their scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2018-032) from SoftSim Technologies Inc. (SoftSim), of Montréal, Quebec, concerning a procurement (Solicitation No. W8474-19-CA21) by the Department of National Defence. The solicitation is for four Level 2 network support specialists. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on September 28, 2018, to conduct an inquiry into the complaint.
SoftSim alleges that the winning bidder did not have access to the resources it certified, in its bid, would be available to perform the work.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2018-031) from V Zero Corporation, of Woodstock, Ontario, concerning a procurement (Solicitation No. M7594-186822/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Royal Canadian Mounted Police. The solicitation is for the provision of rifle plates. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on October 1, 2018, to conduct an inquiry into the complaint.
V Zero Corporation alleges that PWGSC erred in determining that its proposal was non-compliant with the requirements of the solicitation.

FARM PRODUCTS AGENCIES ACT
Notice of a public hearing as part of an inquiry into the merits of establishing a Canadian industrial hemp promotion and research agency
The Farm Products Council of Canada (FPCC) received from the Canadian Hemp Producers a proposal to establish a Canadian Industrial Hemp Promotion and Research Agency, to be funded by levies applied to industrial hemp products marketed domestically as well as on hemp products imported into Canada.
The Council, pursuant to section 8 of the Farm Products Agencies Act (the Act), hereby declares that a panel of two of its members will hold a public hearing to determine the merits of establishing such an agency, pursuant to section 39 of the Act.
The Panel has determined the place and time of the hearing, which will be announced during the preparatory teleconference (see the notice below). The panellists are Council Vice-Chairman, Mike Pickard, as Panel Chair, and Yvon Cyr, member.
The Panel will submit the results of its inquiry to the full Council and the Council will make a report with recommendations to the Minister of Agriculture and Agri-Food Canada.
The Council's Panel will enquire into and review
- (a) the current status of Canadian industrial hemp producers and importers and the degree of support among them for establishing an agency;
- (b) the potential effects of establishing a national agency on the operations of producers and importers, on the development of the industry, its competitiveness and markets, on rural economies and on the Canadian agriculture and agri-food sector;
- (c) the means for ensuring that an agency has due regard for the interests of producers, importers and consumers;
- (d) the draft Promotion and Research Plan in the proposal, the priority projects, including their potential relationships with Agriculture and Agri-Food Canada and Government of Canada programs, and the resource requirements and sources;
- (e) the degree and nature of federal and provincial co-operation required to implement the proposed national plan, particularly with respect to levy collection authorities and consistency with the Agreement on Internal Trade;
- (f) the collection of levies on imported industrial hemp and hemp products, including its consistency with Canada's rights and obligations under international trade agreements;
- (g) the financial viability of the proposed agency; and
- (h) whether any restrictions should be placed on the proposed agency or any of the powers to be exercised pursuant to section 42 of the Act.
