Certain silicon metal — Decision
On May 15, 2017, pursuant to subsection 39(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency extended the time period for making preliminary determinations with respect to the investigations into the alleged injurious dumping of certain silicon metal originating in or exported from the Federative Republic of Brazil (Brazil), the Republic of Kazakhstan (Kazakhstan), Lao People's Democratic Republic, Malaysia, the Kingdom of Norway (Norway), the Russian Federation and the Kingdom of Thailand (Thailand), and the alleged injurious subsidizing of certain silicon metal originating in or exported from Brazil, Kazakhstan, Malaysia, Norway and Thailand.
SIMA provides that, under normal circumstances, the preliminary stage of the investigations shall be completed within 90 days of the date of initiation. However, due to the complexity and novelty of the issues presented by the investigations, the period has been extended to 135 days, pursuant to subsection 39(1) of SIMA.
Consequently, the preliminary determinations will be made on or before July 5, 2017.

Architect and engineering services
The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2017-009) from Smith Vigeant architectes inc. + ABCP architecture (SVA + ABCP), of Québec (Quebec), concerning a procurement (Solicitation No. 5P301-16-0005) by the Parks Canada Agency (PCA). The solicitation is for the provision of heritage architecture services on PCA historic sites and heritage buildings. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on May 16, 2017, to conduct an inquiry into the complaint.
SVA + ABCP disputes the PCA's decision to declare its proposal non compliant with respect to certain mandatory requirements of the solicitation.

Marine fuel (energy)
The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2017-010) from MLS (Overseas) Ltd. (MLS), of Braintree, United Kingdom, concerning a procurement (Solicitation No. W010X-16B042/A) by the Department of Public Works and Government Services (PWGSC). The solicitation is for logistic support services of a recognized marine fuel supplier. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on May 11, 2017, to conduct an inquiry into the complaint.
MLS alleges that PWGSC improperly awarded a standing offer to a bidder who, at the time of award, did not have the required security clearance.

NATIONAL ENERGY BOARD
APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES
Rubicon NYP Corp
By an application dated May 18, 2017, Rubicon NYP Corp (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export up to 1 800 000 MWh of combined firm and interruptible energy annually for a period of 10 years.
The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The directions on procedure that follow explain in detail the procedure that will be used.
- The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Rubicon Energy Group, 386 Le Moyne Street, Suite 201, Montréal, Quebec, Canada H3C 3R6, 514-232-1764 (telephone), jp@rubiconnyp.com (email), to the attention of Jean-Philippe Taillon, and provide a copy of the application to any person who requests one. - Pursuant to subsection 119.06(2) of the Act, the Board is interested in the views of submitters with respect to
- (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
- (b) whether the Applicant has
- (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
- (ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.
- Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by July 16, 2017.
