Certain oil country tubular goods — Decisions

On July 21, 2014, pursuant to subsection 31(1) of the Special Import Measures Act, the President of the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping of certain oil country tubular goods originating in or exported from Chinese Taipei, India, Indonesia, the Philippines, the Republic of Korea, Thailand, Turkey, Ukraine and Vietnam, and the alleged injurious subsidizing of certain oil country tubular goods originating in or exported from India, Indonesia, the Philippines, the Republic of Korea, Thailand, Turkey, Ukraine and Vietnam.

As of January 1, 2012, the goods in question are usually classified under the following Harmonized System numbers:

The Canadian International Trade Tribunal (Tribunal) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping or subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th floor, Ottawa, Ontario K1A 0L8. To be given consideration in these investigations, this information should be received by August 27, 2014.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Oil country tubular goods

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2014-002) to determine whether the evidence discloses a reasonable indication that the alleged injurious dumping of oil country tubular goods, which are casing, tubing and green tubes made of carbon or alloy steel, welded or seamless, heat-treated or not heat-treated, regardless of end finish, having an outside diameter from 2 ⅜ inches to 13 ⅜ inches (60.3 mm to 339.7 mm), meeting or supplied to meet American Petroleum Institute (API) specification 5CT or equivalent and/or enhanced proprietary standards, in all grades, excluding drill pipe, pup joints, couplings, coupling stock and stainless steel casing, tubing or green tubes containing 10.5% or more by weight of chromium, originating in or exported from Chinese Taipei, the Republic of India, the Republic of Indonesia, the Republic of the Philippines, the Republic of Korea, the Kingdom of Thailand, the Republic of Turkey, Ukraine and the Socialist Republic of Vietnam, and the alleged injurious subsidizing of the above-mentioned goods originating in or exported from the Republic of India, the Republic of Indonesia, the Republic of the Philippines, the Republic of Korea, the Kingdom of Thailand, the Republic of Turkey, Ukraine and the Socialist Republic of Vietnam (the subject goods), have caused injury or retardation or are threatening to cause injury to the domestic industry, as these words are defined in SIMA.

The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Secretary on or before August 5, 2014. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before August 5, 2014.

On August 8, 2014, the Tribunal will issue a List of Participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the List of Participants. Ten copies of all submissions must be served on the Tribunal.

Submissions by parties opposed to the complaint must be filed not later than noon, on August 21, 2014. The complainants may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on August 29, 2014. At that time, other parties in support of the complaint may also make submissions to the Tribunal.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

SPECIES AT RISK ACT

Description of critical habitat of American Marten in Gros Morne National Park of Canada and Terra Nova National Park of Canada

The American Marten (Martes americana atrata), Newfoundland population, is a species listed on Schedule 1 to the Species at Risk Act as threatened. The American Marten is a member of the weasel family that is slightly smaller than a house cat and lives in forested habitats. The Recovery Strategy for the American Marten (Martes americana atrata), Newfoundland population, in Canada (www.sararegistry.gc.ca/species/speciesDetails_e.cfm?sid=134) identifies critical habitat for the species in a number of areas, including two federally protected areas.

Notice is hereby given that, pursuant to subsection 58(2) of the Species at Risk Act, subsection 58(1) of that Act applies, 90 days after the date of publication of this notice, to the critical habitat of the American Marten, Newfoundland population — identified in the recovery strategy for that species that is included in the Species at Risk Public Registry — that is located within the following federally protected areas: Gros Morne National Park of Canada and Terra Nova National Park of Canada, who's boundaries are described in Schedule 1 to the Canada National Parks Act.
