SPECIAL IMPORT MEASURES ACT

Certain concrete reinforcing bar — Decisions

On June 13, 2014, pursuant to subsection 31(1) of the Special Import Measures Act, the President of the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain concrete reinforcing bar originating in or exported from the People's Republic of China, the Republic of Korea, and the Republic of Turkey.

As of January 1, 2012, the goods in question are usually classified under the following Harmonized System classification numbers:

7213.10.00.00
7214.20.00.00

The Canadian International Trade Tribunal (Tribunal) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA Web site at www.cbsa-asfc.gc.ca/sima-lmsi or by contacting either Mr. Sean Robertson at 613-948-8581 or Mr. Paul Pomnikow at 613-948-7809, or by fax at 613-948-4844.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping or subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario K1A 0L8. To be given consideration in these investigations, this information should be received by July 21, 2014.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Concrete reinforcing bar

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2014-001) to determine whether the evidence discloses a reasonable indication that the alleged injurious dumping and subsidizing of hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly identified as rebar, in various diameters up to and including 56.4 millimeters, in various finishes, excluding plain round bar and fabricated rebar products, originating in or exported from the People's Republic of China, the Republic of Korea and the Republic of Turkey (the subject goods), have caused injury or retardation or are threatening to cause injury to the domestic industry, as these words are defined in SIMA.

The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Secretary on or before July 2, 2014. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before July 2, 2014.

On July 4, 2014, the Tribunal will issue a List of Participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. This information will be included in the List of Participants. Ten copies of all submissions must be served on the Tribunal.

Submissions by parties opposed to the complaint must be filed not later than noon, on July 15, 2014. The complainants may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on July 22, 2014. At that time, other parties in support of the complaint may also make submissions to the Tribunal.

NATIONAL ENERGY BOARD

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Northern States Power Company, a Minnesota corporation

By an application dated June 16, 2014, Northern States Power Company, a Minnesota corporation (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export up to 800 000 MWh of firm energy and up to 800 000 MWh of interruptible energy annually for a period of 10 years.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.

  1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Northern States Power Company, a Minnesota corporation, 1800 Larimer Street, Suite 1000, Denver, Colorado 80202, Attention: Michael Flexter, 303-571-6502 (telephone), 303-571-7375 (fax), mike.flexter@xcelenergy.com (email), and provide a copy of the application to any person who requests one.       • (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
      • (ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.
  4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by August 12, 2014.

SPECIES AT RISK ACT

Description of critical habitat for Alberta populations of Westslope Cutthroat Trout in Banff National Park of Canada

The Westslope Cutthroat Trout (Oncorhynchus clarkii lewisi), Alberta populations, is a freshwater fish listed on Schedule 1 to the Species at Risk Act as threatened. There are 14 subspecies of cutthroat trout that are generally recognized, but Westslope Cutthroat Trout is the only subspecies native to the province of Alberta. The Recovery Strategy for the Westslope Cutthroat Trout (Oncorhynchus clarkii lewisi), Alberta populations in Canada is available on the Species at Risk Public Registry (www.sararegistry.gc.ca/virtual_sara/files/plans/rs_truite_fardee_wstslp_cutthroat_trout_0314_e.pdf). The recovery strategy identifies critical habitat for Westslope Cutthroat Trout in a number of locations, including 10 areas within Banff National Park of Canada.

Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of Alberta populations of Westslope Cutthroat Trout — identified in the recovery strategy for that species that is included in the Species at Risk Public Registry — that is located within Banff National Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.

The Public Service Commission of Canada, pursuant to section 116 of the Public Service Employment Act, hereby gives notice that it has granted permission, pursuant to subsection 115(2) of the said Act, to Corinne Webb, Acting Appeals Officer (SP-6), whose substantive position is Specialty Tax Auditor/Examiner (SP-5), Winnipeg Tax Services Office, Canada Revenue Agency, Winnipeg, Manitoba, to be a candidate, before and during the election period, for the positions of Councillor, Ward 4, and Deputy Mayor for the Rural Municipality of Ritchot, Manitoba, in a municipal election to be held on October 22, 2014.
