Certain liquid dielectric transformers — Decision

On March 6, 2014, the President of the Canada Border Services Agency (CBSA) made a new final determination of dumping, pursuant to paragraph 41.1(1)(a) of the Special Import Measures Act, in respect of liquid dielectric transformers having a top power handling capacity equal to or exceeding 60 000 kilovolt-amperes (60 megavolt-amperes), whether assembled or unassembled, complete or incomplete, originating in or exported from the Republic of Korea.

This decision stems from a decision of the Federal Court of Appeal made on December 6, 2013, that, as a result of an application for judicial review, set aside the original final determination made on October 22, 2012, and referred the matter back to the President for reconsideration.

The goods in question are usually classified under the following Harmonized System classification number:

As a result of the new final determination, anti-dumping duty will be reimposed on imports of subject goods. The Canadian International Trade Tribunal has been informed of this decision pursuant to paragraph 41.1(b) of the Special Import Measures Act.

The future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping on the goods. The importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

AMENDMENTS

1. The portion of paragraphs 3.1(a) and (b) of the table to Part 6 of the Canadian Food Inspection Agency Fees Notice in column 2 is replaced by the following:

EXPLANATORY NOTE

The Canadian Food Inspection Agency Fees Notice (Fees Notice) was made by the Minister of Agriculture and Agri-Food on May 13, 2000, under the authority of the Canadian Food Inspection Agency Act.

A destination inspection is a quality inspection of domestic fresh produce shipments or produce entering Canada from a foreign jurisdiction, intended to provide buyers and sellers of fresh produce with an impartial report on the quality and condition of the produce. The impartial report supports the process through which the fresh produce industry settles commercial disputes. In the absence of a fair and unbiased third-party assessment regarding the quality and condition of a shipment, dealers, domestic or international, may be at a disadvantage in the event of a dispute. The destination inspection service also provides witnessing of the destruction or disposal of fresh produce and issuance of a Notice of Dumping or other Disposition, should such services be required.

The Canadian Food Inspection Agency (CFIA) is implementing the final step of a three-year phased-in approach to fully cost recover the destination inspection service program. Fees associated with destination inspection services set out in the Fees Notice — Part 6, item 3.1, are currently set to recover 75% of full cost recovery for the services, based on the hourly costs. The fully cost recovered fees will allow for the continued provision of a high quality and respected inspection service that is of direct benefit to the fresh produce industry.

The CFIA undertook a 70-day consultation on the phase 3 user fee proposal from December 13, 2012, to February 21, 2013. The mechanisms used to facilitate the consultation involved posting the user fee proposal on the CFIA Web site, issuing a World Trade Organization notification, providing a link to the Consulting Canadians Web site, and outreach through front-line staff. The results of this consultation process have been shared in a summary document that was published on the CFIA Web site.

This Notice modifies the fees associated with destination inspection under the Canadian Food Inspection Agency Fees Notice to allow for full cost recovery of the program.

Certain fasteners

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its order made on January 6, 2010, in Expiry Review No. RR-2009-001, continuing, with amendment, its findings made on January 7, 2005, in Inquiry No. NQ-2004-005, concerning the dumping of certain carbon steel fasteners originating in or exported from the People's Republic of China and Chinese Taipei and the subsidizing of such products originating in or exported from the People's Republic of China, is scheduled to expire (Expiry No. LE-2013-003) on January 5, 2015. Under SIMA, an order or finding of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

The Tribunal's expiry proceeding will be conducted by way of written submissions. Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Secretary on or before March 18, 2014. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before March 18, 2014.

On March 19, 2014, the Tribunal will distribute the list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. Ten copies of all submissions must be served on the Tribunal.

Parties requesting or opposing the initiation of an expiry review of the said order shall file their written public submissions containing relevant information, opinions and arguments, with the Secretary of the Tribunal, counsel and parties of record, no later than March 28, 2014. Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. Parties wishing to respond to the submissions must do so no later than April 7, 2014.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

The Tribunal will issue a decision on April 23, 2014, on whether an expiry review is warranted. If the Tribunal decides that an expiry review is not warranted, the order will expire on its scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.
