Compliance agreement
This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9 (hereafter referred to as the “Act”).
On November 7, 2013, pursuant to section 517 of the Act, the Commissioner of Canada Elections entered into a compliance agreement with Ms. Helen Gerteis (hereafter referred to as the “Contracting Party”) of Georgetown, in the province of Ontario, who was the official agent of Charlie Angus, a candidate in the 2008 and 2011 federal general elections in the electoral district of Timmins—James Bay.
The Contracting Party has acknowledged acts that constituted a failure to comply with section 437 of the Act, which requires that the official agent open a separate bank account for the sole purpose of the candidate's electoral campaign and close that account after the election, once any unpaid claim or surplus has been dealt with.
The Contracting Party acknowledged that the bank account opened for the candidate's electoral campaign for the 2008 general election was not closed, that the same bank account remained open and was used for the 2011 general election and that a new, separate bank account was therefore not opened for the 2011 general election.
The Contracting Party acknowledged and accepted responsibility for these acts, and is now aware of section 437 of the Act and the offence provisions at paragraph 497(1)(r) of the Act.
Prior to the conclusion of the compliance agreement, the Commissioner of Canada Elections took into account that the Contracting Party provided the Commissioner with proof that the bank account used for the candidate's campaigns in the 2008 and 2011 general elections had been closed.
