Certain hot-rolled carbon steel plate and high-strength low-alloy steel plate — Decision

On September 5, 2013, pursuant to subsection 31(1) of the Special Import Measures Act, the President of the Canada Border Services Agency (CBSA) initiated an investigation into the alleged injurious dumping of certain hot-rolled carbon steel plate and high-strength low-alloy steel plate originating in or exported from Brazil, Chinese Taipei, Denmark, Indonesia, Italy, Japan and the Republic of Korea.

The goods in question are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

The Statement of Reasons regarding this decision will be issued within 15 days following the decision and will be available on the CBSA’s Web site at www.cbsa.gc.ca/sima or by contacting Barbara Chouinard at 613-954-7399, or by fax at 613-948-4844.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping. COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Hot-rolled carbon steel plate

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2013-003) to determine whether the evidence discloses a reasonable indication that the alleged injurious dumping of hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths from 24 inches (+/- 610 mm) to 152 inches (+/- 3,860 mm) inclusive, and thicknesses from 0.187 inches (+/- 4.75 mm) up to and including 3.0 inches (76.2 mm) (with all dimensions being plus or minus allowable tolerances contained in the applicable standards), but excluding plate for use in the manufacture of pipe and tube (also known as skelp); plate in coil form, plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), originating in or exported from the Federative Republic of Brazil, Chinese Taipei, the Kingdom of Denmark, the Republic of Indonesia, the Italian Republic, Japan, and the Republic of Korea (the subject goods), has caused injury or retardation or is threatening to cause injury, as these words are defined in SIMA.

The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Secretary on or before September 23, 2013. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before September 23, 2013.

On September 24, 2013, the Tribunal will issue a List of Participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. This information will be included in the List of Participants. Ten copies of all submissions must be served on the Tribunal.

Submissions by parties opposed to the complaint must be filed not later than noon, on October 8, 2013. The complainant may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on October 16, 2013. At that time, other parties in support of the complaint may also make submissions to the Tribunal.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a version or summary cannot be made.

Information processing and related telecommunications services

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2013-012) from Access Corporate Technologies Inc. (ACT), of Ottawa, Ontario, concerning a procurement (Solicitation No. T8080-130016) by the Department of Transport (Transport Canada). The solicitation is for the provision of the services of a human resources consultant, a change management consultant, and organizational design and classification consultants in support of key priorities within the Marine Safety and Security Program at Transport Canada. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

ACT alleges that Transport Canada incorrectly awarded a contract to a non-compliant bidder.

REGULATORY POLICY

Amendments to the Radio Regulations, 1986 concerning basic Canadian content development contributions and the addition of a definition of the Community Radio Fund of Canada

The Commission has amended subsection 15(2) of the Radio Regulations, 1986 in order to relieve licensees of commercial or ethnic radio stations with total revenues of $1,250,000 or less of the requirement to make basic Canadian content development contributions. The Commission has also made a related amendment deleting subsection 15(4).

Further, the Commission has added a definition of the Community Radio Fund of Canada to subsection 15(1).

These amendments will simplify the administration of the current policy, while reducing the regulatory burden on the smallest stations and maintaining an appropriate level of funding for Canadian music initiatives.

The amendments were published in the Canada Gazette, Part Ⅱ, on August 14, 2013. They came into effect on September 1, 2013. A copy of the amendments is appended to the regulatory policy.
