Certain galvanized steel wire — Decisions

On July 22, 2013, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), in respect of certain galvanized steel wire originating in or exported from the People’s Republic of China (China), the State of Israel and the Kingdom of Spain and made a final determination of subsidizing in respect of the above-mentioned goods originating in or exported from China.

The goods in question are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make a finding by August 20, 2013. Provisional duties will continue to apply until this date on imports of subject goods from these three countries.

If the Tribunal finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping and/or countervailing duty equal to the amount of subsidy on the goods. In that event, the importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

Certain silicon metal — Decision

On July 22, 2013, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the President of the Canada Border Services Agency (CBSA) made a preliminary determination of dumping and a preliminary determination of subsidizing in respect of silicon metal containing at least 96.00% but less than 99.99% silicon by weight, and silicon metal containing between 89.00% and 96.00% silicon by weight that contains aluminum greater than 0.20% by weight, of all forms and sizes, originating in or exported from the People’s Republic of China.

The goods in question are usually classified under the following Harmonized System classification number: 2804.69.00.00.

On June 21, 2013, the Canadian International Trade Tribunal (Tribunal) determined that the evidence disclosed a reasonable indication that the dumping and subsidizing of silicon metal have caused or are threatening to cause injury. The Tribunal will now conduct a full inquiry into the question of injury to the Canadian producers of certain silicon metal, and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determinations of dumping and subsidizing.

Pursuant to section 8 of SIMA, provisional duty is payable on the dumped and subsidized subject silicon metal originating in or exported from the People’s Republic of China that is released from the CBSA during the period commencing on July 22, 2013, and ending on the earlier of the day the investigations are terminated, the day on which the Tribunal makes an order or finding, or the day an undertaking is accepted.

The amount of provisional duty payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

COMMENCEMENT OF INQUIRY

Silicon metal

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on July 22, 2013, from the Acting Director General of the Anti-dumping and Countervailing Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations had been made respecting the dumping and subsidizing of silicon metal containing at least 96.00 percent but less than 99.99 percent silicon by weight, and silicon metal containing between 89.00 percent and 96.00 percent silicon by weight that contains aluminum greater than 0.20 percent by weight, of all forms and sizes, originating in or exported from the People’s Republic of China.

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2013-003) to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Secretary on or before August 6, 2013. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before August 6, 2013.

A public hearing relating to this inquiry will be held in the Tribunal’s Hearing Room No. 1, 18th Floor, 333 Laurier Avenue W, Ottawa, Ontario, commencing on October 21, 2013, at 9:30 a.m.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

Description of critical habitat for Woodland Caribou, Boreal population, in Wood Buffalo National Park of Canada and Prince Albert National Park of Canada

The boreal population of Woodland Caribou (Rangifer taranadus caribou), also known as boreal caribou, is listed on Schedule 1 to the Species at Risk Act as threatened. Boreal caribou are a medium-sized member of the deer family and are found within the boreal forest across Canada in seven provinces and two territories. The recovery strategy for boreal caribou in Canada is available on the Species at Risk Public Registry (www.sararegistry.gc.ca/document/default_e.cfm?documentID= 2253). The recovery strategy includes an identification of critical habitat for boreal caribou in a number of locations, including within federally protected areas.

Notice is hereby given that, pursuant to subsection 58(2) of the Species at Risk Act, subsection 58(1) of that Act applies, 90 days after this publication, to the critical habitat of the Woodland Caribou, Boreal population — identified in the recovery strategy for that species that is included in the Species at Risk Public Registry — that is located within the following protected areas: Wood Buffalo National Park of Canada and Prince Albert National Park of Canada, who’s boundaries are described in Schedule 1 to the Canada National Parks Act. For greater certainty, the locations within which critical habitat can be found within these national parks are indicated in the maps below (Figures 1 and 2). Those locations correspond to portions of the Northwest Territory Range (NT1), Caribou Mountains Range (AB4), and Red Earth Range (AB6) within Wood Buffalo National Park of Canada, and a portion of the Boreal Plain Range (SK2) within Prince Albert National Park of Canada. Details and fact sheets describing the biophysical attributes of the critical habitat within those ranges can be found in Appendix G and Appendix H in the recovery strategy.
